INLAND WETLANDS AND WATERCOURSES COMMISSION
MINUTES
December 10, 2008

PRESENT: Chairman David Tolli, Barry Avery, Richard Martindale, Charlie Katan, Richard Van Nostrand, and David Askew, Technical Advisor to the Commission.

Chairman Tolli called the meeting to order and confirmed a quorum at 7:10 p.m.

ON A MOTION by Mr. Martindale, seconded by Mr. Avery, the commission voted (5-0-0) to accept the minutes of the October 8, 2008 meeting.
Mr. Katan noted that minutes should state whether or not a permit was granted when an application is voted on.

PUBLIC HEARINGS

2A. Wetland Boundary Change, Dixon/Chase, 95 Day Street
Builder John Fitzgerald and Soil Scientist Tom Pietras made the presentation.
Chairman Tolli, Barry Avery, Dr. Martindale, and David Askew visited the site November 23 for review of the map.  On 11/29/08, Mr. Askew met with the soil scientist, Tom Pietras, to review the property and agreed an adjustment to the map was needed.  A revised map was submitted with the addition of a notation identifying a non-regulated drainage swale connecting a wetland in the field to an intermittent watercourse in the woods.  The hearing was opened to the public for comment.  None were made.

ON A MOTION by Mr. Avery, seconded by Mr. Martindale, the public hearing was closed at 7:20 p.m.  (5-0-0)

2B. Wetland Boundary Change, Okie, 147 Loomis St.
Owner Susan Okie and soil scientist Tom Pietras made the presentation.
Chairman Tolli and David Askew visited the site November 23 and found no discrepancies with the map.
The hearing was opened to the public for comment.  None were made.

ON A MOTION by Mr. Martindale and seconded by Mr. Avery, the public hearing was closed at 7:25.  (5-0-0)

WETLAND BOUNDARY CHANGES

3A. Wetland Boundary Change, Dixon/Chase, 95 Day Street
The revised map provided for the wetland boundary is substantially correct and any minor discrepancies would have little to no effect on the regulated areas.

ON A MOTION by Mr. Van Nostrand, seconded by Mr. Katan, the commission accepts the following wetland boundary map: Wetlands Line Amendment Plan, prepared for Charles M. Dixon & Carol L. Chase, 95 Day St., Granby, CT, dated 11/10/08, revised 12/3/08.  (5-0-0)

3B. Wetland Boundary Change, Okie, 147 Loomis St.

ON A MOTION by Mr. Katan, seconded by Mr. Van Nostrand, the commission accepts the following wetland boundary map: Partial Wetlands Boundary Correction Map prepared for Susan Okie, 147 Loomis St., Granby, CT, dated 11/14/08, no revision.

NEW APPLICATIONS
No applications.

CEASE ORDER:
5a. Cynthia Anne Berkowitz, 63 Cooley Road (11/2/2005)
The cease order is still in effect, and the town attorney is prosecuting the matter.  There was no new progress to report.

REPORT OF DESIGNATED AGENT:
6A. Request for Review – Signed

6B. Request for Review – Pending
215 Case St., Tallon Lumber, timber harvest
Forester Charles Tirrell presented the proposed activity at the Adams Evergreen Farm involving three stream crossings.  The proposed crossings are at the narrowest part of the stream.  There are no other access points to the area for harvesting.  Dave Askew has visited the site and reviewed the proposal contained in the Request for Review.  Mr. Van Nostrand noted that this watercourse (Cherry Brook) is an important spawning area for several fish species. Mr. Tirrell agreed that no work involving the stream crossings would be done during the period March 1 thru May 15 (during the Atlantic salmon run); and that hay bales and silt fences would be used as required.  Double bridges will be used on the main stem of the brook.  Permission to sign the request is granted.  (5-0-0)

6C. Violations
10 Allen Rd., Markiewicz, unauthorized activity in a watercourse
The new owner of the property cut a road down to the water and constructed a crick structure into the water.  The structure has been removed.  Dave Askew distributed a notice of violation letter dated 11/4/08 that he had sent to Mr. Markiewicz.  The letter stated what constituted violation and what remediation steps were required.  Mr. Askew has met with Mr. Markiewicz and the remediation work is being done.  An application for some sort of activity on this site is expected next summer.  The owner has been cooperative in adhering to the recommendations of the designated agent.


MISCELLANEOUS:
7A. Manitook Lake, milfoil
Chairman Tolli will attempt to have the appropriate representative from the Manitook Lake Association address us at the next meeting.  
At the suggestion of Mr. Avery, Mr. Askew was requested to draft a letter to the Department of Environmental Protection (DEP), copied to the lake association, expressing the commission’s concern with potential impact on Salmon Brook of any milfoil control activity in Manitook Lake.

7B. Freedom of Information Act (FOIA) Seminar
Chairman Tolli reported on two items gleaned from a seminar he attended 12/3/08 on the subject: 1. Minutes must record how individual members vote; 2. In order to avoid potential problems with whether a site walk constitutes a meeting that must be open to the public, it was suggested that only one member accompany Mr. Askew at a time.

7C. Rivers Alliance Conference information
At the next meeting, Chairman Tolli will distribute information he gathered at the subject conference.

The next monthly meeting is January 14, 2009 at 7:00 p.m. in the Town Hall meeting room.

ON A MOTION by Mr. Avery, seconded by Mr. Van Nostrand, the commission voted (5-0-0) to adjourn the meeting at 8:00 p.m.
