INLAND WETLANDS AND WATERCOURSES COMMISSION
MINUTES
October 14, 2009

PRESENT: Chairman David Tolli, Barry Avery, Eric Lukingbeal, Richard Martindale, Charlie Katan, and David Askew, Technical Advisor to the Commission.

Chairman Tolli called the meeting to order and confirmed a quorum at 7:07p.m.

MINUTES: Lucille delCampo, 196 West Granby Road, submitted two corrections to the September 9, 2009 minutes.  First, the delCampo family owned the property since 1966 and was built on in 1979.  Second, the photos mentioned are not of 192 West Granby Road, but of the wet conditions along the north and west boundaries of 192 West Granby Road, which is owned by the delCampos.

ON A MOTION by Mr. Avery, seconded by Mr. Lukingbeal, the commission voted (4-0-0) to accept the minutes of the September 9, 2009 meeting with the above corrections.

PUBLIC HEARINGS

2a. Application for new house, 192 West Granby Road, Ed Sansone
Mr. Avery recused himself from any discussion on this matter.
Chairman Tolli opened the public hearing by reading the public notice.  Alyssa Pershan, attorney for Mr. Sansone, introduced Mark Kement, PE/LS of Sanderson and Washburn.  Mr. Kement described the proposed project.  The plan calls for a single-family residence with on-site septic system and well.  The lot is 1.03 acres.  The Farmington Valley Health District (FVHD) approved results from test pits for the septic on August 3, 2009.  The analysis was submitted to the commission.  There is 25’ clearance from the proposed foundation to the wetlands.  Chairman Tolli points out that the lot has been carried on the town’s tax rolls as unbuildable for years and ought to remain as such.  Commission members asked questions about the proposed location of the house, the type of basement planned and septic location.  Mr. Kement spoke of three possible alternatives for house placement and explained the reason for the choice made.  Discussion ensued over the possibility of shifting the house and septic to move activity further from wetland areas.  Feasibility tests for an alternate septic location have not been performed.  
Mr. Richard delCampo, 196 West Granby Road, stated that he has had apprehension about the proposed project and, now hearing additional information, is strongly opposed to it.  He read from a letter he drafted to the commission.  The letter includes a timeline of events and activities regarding the lot at 192 West Granby Road.  He referred to Planning and Zoning regulations, Inland Wetland and Watercourses Commission minutes, soil reports, Assessor amendment, and conversations with Mr. Sansone and the Director of Community Development.  Mr. delCampo points out that the lot is assessed as unbuildable and is further concerned that the proposed sewage system is 12’ from his property and would be too close to his pond.
Mr. Jim Glenney, of 33 Glen Road, asked when the lot was declared unbuildable.  On April 24, 2003 it was deemed unacceptable for septic and was not to be sold as a building lot and on July 8, 2003 the assessor’s office submitted a letter to the tax department adjusting the assessment to unbuildable.  Mr. Glenney then asks, what has changed?  The change is the approval for a septic system obtained from the FVHD.  
The applicant is asked to move the septic system back, closer to the second alternative Sanderson and Washburn proposed.

ON A MOTION by Mr. Lukingbeal, seconded by Mr. Martindale, the commission continues the public hearing.  (4-0-0)

NEW APPLICATIONS
3a. Ed Sansone, 192 West Granby Road, new house
Continued to next month’s meeting.  Mr. Avery recused.

CEASE ORDER:
4a. Cynthia Anne Berkowitz, 63 Cooley Road (11/2/2005)
Mr. Askew has drafted a letter conclude the cease and desist order.

4b. Cambridge House, redux
Tom Grimaldi, engineer for the redesign, submitted a letter to the commission stating that the project has been completed to his design.

ON A MOTION by Mr. Lukingbeal, seconded by Mr. Katan, the commission removes the cease and desist order.

REPORT OF DESIGNATED AGENT:
5a. Request for Review – Signed
        1. 9 Barn Door Hills Road, fill depression in farm field
        2. 255 Hungary Road, deck installation
        Mr. Askew reviewed the request and deemed all in order.  The request was signed.

5b. Request for Review – Pending
       1. 235 North Granby Road, farm road in wetland
        Mr. Robert Brockett lives on the property and explains that the brook snakes back and forth through his land.  He would like to put in an access road to reach the outer areas of his property.  He used to have cattle that could cross the brook but now he has horses that tend to get stuck as they attempt to cross.  Mr. Martindale would like to take a look at the property.   This matter requires an application. Mr. Lukingbeal recused.
        
MISCELLANEOUS:
6a. The commission agrees to continue to hold meetings on the second Wednesday of the month.
6b. Chairman Tolli advised the commission of upcoming trainings.  Mr. Askew will email the members of the available dates.
6c. The Connecticut Federation of Lakes will hold meetings on October 27 and October 28 in Hartford.
6d. The CACIWC meeting is scheduled for November 14, 2009.

ANY OTHER PROPER BUSINESS:

ON A MOTION by Mr. Avery, seconded by Mr. Martindale, the commission moved into executive session at 8:20 p.m.  All present members and Mr. Askew attended.
ON A MOTION by Mr. Lukingbeal, seconded by Mr. Katan, the commission exited executive session at 8:30 p.m.

The next monthly meeting is November 11, 2009 at 7:00 p.m. in the Town Hall meeting room.

ON A MOTION by Mr. Avery, seconded by Mr. Lukingbeal, the commission voted to adjourn the meeting at 8:31 p.m.
