INLAND WETLANDS AND WATERCOURSES COMMISSION
MINUTES
November 18, 2009

PRESENT: Chairman David Tolli, Richard Martindale, Charlie Katan, Neil Kraner and David Askew, Technical Advisor to the Commission.

Chairman Tolli called the meeting to order and confirmed a quorum at 7:03p.m.

MINUTES:

ON A MOTION by Mr. Katan, seconded by Mr. Kraner, the commission voted (3-0-1) to accept the minutes of the October 14, 2009 meeting.  (Mr. Kraner abstains.)

PUBLIC HEARINGS

2a. Application for new house, 192 West Granby Road, Ed Sansone
Mr. Sansone sent a letter to the commission requesting that the hearing be delayed.  Alyssa Pershan, attorney for Mr. Sansone, appeared to be certain the letter was received.

NEW APPLICATIONS
3a. Ed Sansone, 192 West Granby Road, new house
Continued to next month’s meeting.  
3b. New 9-lot development, 95 Day Street, Dickson/Case
Tom Grimaldi, lead engineer for the project, and Robert Hiltbrant, drainage expert, presented the project.  The property in consideration is approximately 150 acres.  This is a mostly wooded site.  Only 3 ½ acres are non-wooded.  The plan is to utilize 12 acres for the project for the 9 single-family homes.  The remainder of the land will be deeded to open space, land trust and agricultural use.  Access to the subdivision will be at 81 Day Street.  Proposed lot sizes range from .8 acres to 1.8 acres.  The proposed road will be primarily flat.  It will be crowned to promote sheet flow to bio-retention units.  Two catch basins will be included.  Total disturbed area during construction is 5.8 acres.  All fill materials will stay on the site for use in the project.  There are no wetland disturbances.  The encroachments on regulated areas occur on proposed lots 6, 7, and 9.
A public hearing on this matter is scheduled for next month’s meeting.
3c. Road in wetland, 235 North Granby Road, Bob Brockett
A very small percentage of land is affected by the proposed project.  A public hearing on this matter is scheduled for next month’s meeting.

Mr. Askew will draft a letter to lift the order since actions to amend the situation, to the commission’s approval, have been taken.

REPORT OF DESIGNATED AGENT:
5a. Request for Review – Signed
        1. 46 Twilight Drive, shed
        Activity for the project does not encroach on regulated areas.
        
MISCELLANEOUS:
6a. New forms are required by law.  Designated agents are not authorized to sign off on activities within wetland areas.  This means that the short form may not be used.  Charges should be assessed ($50).  Also, applicants must notify abutters of an agent’s review within ten days of the filed application.
6b. The wild and scenic committee is looking to have towns submit for its endorsement.  The committee will meet with development planners.  Additional information is forthcoming.
6c. Chairman Tolli shared highlights from the CACIWC meeting.  Debate on agricultural exemptions was discussed.  Questions on what constitutes a quorum when a member is recused were raised.  And restrictions on activities cannot be assessed unless an application has been filed.

ANY OTHER PROPER BUSINESS:

A complaint from a Canton resident was received.  Activities at 240 Case Street have caused a dam breech and sedimentation issues.  Since this involves a dam, the Department of Environmental Protection should be contacted.

The next monthly meeting is December 9, 2009 at 7:00 p.m. in the Town Hall meeting room.

ON A MOTION by Mr. Martindale, seconded by Mr. Katan, the commission voted to adjourn the meeting at 8:33 p.m.
