INLAND WETLANDS AND WATERCOURSES COMMISSION
MINUTES
December 9, 2009

PRESENT: Chairman David Tolli, Richard Martindale, Barry Avery, Neil Kraner and David Askew, Technical Advisor to the Commission.

Chairman Tolli called the meeting to order and confirmed a quorum at 7:06 p.m.

MINUTES: In reviewing the minutes of last month’s meeting the following corrections are noted:
It was a special meeting due to the change in the regular schedule.  (The third Wednesday of the month fell on Veterans’ Day.  The meeting was rescheduled to the following week.)  
On the matter of 240 Case Street (item under Any Other Proper Business) it is noted that the dam breech occurred as a result of natural causes, not as a result of activity on the property.
Under item 3b the name Chase was spelled incorrectly and Hilderbrant was also misspelled.

ON A MOTION by Mr. Kraner, seconded by Mr. Avery, the commission voted (3-0-1) to accept the minutes of the November 18, 2009 meeting noting the corrections.  Mr. Avery abstains.

PUBLIC HEARINGS

2a. Application for new house, 192 West Granby Road, Ed Sansone
Mr. Avery recused.  
Mark Kement presented three alternatives to the original proposal at last month’s meeting.  After hearing them, the commission suggested a fourth.  Shift the house location to the front of the lot, closer to the street and locate the septic at the rear.  This is the plan now presented.  The driveway is shortened and Farmington Valley Health District (FVHD) approval has been received.  The current proposal puts the corner of the house 45’ from the wetlands.
The commission asks if any additional information from the soil scientist regarding potential disturbances has been obtained.  It has not.
The public was invited to comment.
Richard DelCompo of 196 West Granby Road says that there has been rain since last month’s meeting and there have been additional wet conditions as a result.
Mr. Martindale would like to see documentation on this lot that shows its status as an approved building lot.  The last information indicates that it has been on the tax role as non-buildable.  The town planner will be consulted.

ON A MOTION by Mr. Kraner, seconded by Mr. Tolli, the commission continues the public hearing pending additional information from the soil scientist stating that any impact on the wetlands would be minimal.

2b. New 9-lot development, 95 Day Street, Dickson/Chase
Tom Grimaldi presented the proposal.
The property is 115 acres of land.  The process started two years ago.  The development will take up 12 acres, 28 acres will become open space, 44 acres will go to the land trust and the remainder will be divided between the current owners and the conservation commission.  Access to the property will be gained at 81 Day Street via an eighteen foot wide private road.  The proposed 4 bedroom houses will be located on the wooded portion of the property, not in the open fields.  The owners are willing to address and improve the current drainage problems occurring on Day Street.   Mr. Grimaldi outlined the plans for catch basins and bio-retention systems.  The only encroachments to regulated areas occur on lots 6, 7 and 9.  Detailed sedimentation and erosion control, silt fencing plans and silt fence check dams were discussed in detail.  A planting schedule and FVHD approval for all nine lots was included in the submitted plans.
The commission asked Mr. Grimaldi what the results of the previous evening’s Planning and Zoning commission meeting were.  The only changes to the proposal would be minor and would not affect the IWWC regulated areas.  Mr. Eric Lukingbeal, now a member of the P & Z stated that Mr. Grimaldi’s account is accurate.
The public was invited to comment.
Mr. Brockett, 235 North Granby Road, commented on the use of specific curbing and the challenge it presents to turtles.
Mr. Howard Berg, 241 North Granby Road, inquired on the northern boundary of the project.

ON A MOTION, by Mr. Avery, seconded by Mr. Kraner, the commission voted unanimously to close the public hearing.

3c. Road in wetland, 235 North Granby Road, Bob Brockett
Mr. Brockett presented maps for review.  The proposed ten foot wide road would run through the swamp.  It is Mr. Askew’s recommendation to include two culverts in the swamp area.
The public was eager to comment.
Richard McDermott, 7 Kearns Drive, is concerned with the lack of information available for public review on this matter.  He questions the necessity of the road.  (Mr. Brockett wishes to access more of his property.)  Mr. McDermott says alternatives have not been presented.  Further concern is the property is being rented.  The proposed road is intended for horse travel but he worries that it will increase ATV travel.  The wildlife in the wetlands may be adversely affected.
Guy Stanhope, 4 Kearns Drive, says the standpipe get too much water.
Gordon Anderson, 19 Kearns Drive, echoes Mr. McDermott’s concerns for wildlife.
June McDermott, 7 Kearns Drive, relates that flooding occurs on her side yard during rain and snowmelt.  She is concerned that changes in the wetlands will make the situation worse.  She submits a request that the road not be allowed.
Eric Lukingbeal, 198 Day Street, asks where the road is going.  He states prudent and feasible alternatives have not been explored and that the application appears to need additional detail.
Howard Berg, 241 North Granby Road, referred to the minutes of the October 14, 2009 meeting that reports that the proposed use is for horses.  He expressed his distain for the current renters and the many animals they have on a small amount of land and the use of ATVs.
Comments not pertaining directly to the issue of the wetland ensued. Chairman Tolli called on those present to stay on topic.

ON A MOTION by Mr. Avery, seconded by Mr. Martindale, the commission unanimously agreed to continue the hearing to next month’s meeting.

5a. Request for Review – Signed
        1. 7 Kearns Drive, garage expansion-redux
        The commission reviewed this in October 2006.  The owner was asked to resubmit the request to   update the record.
5b. Request for Review – Pending
        1. 66 North Granby Road, Neal Jaroch, stone retaining wall
        The plan was reviewed by the commission.  The request is granted provided the owner installs    silt fencing during the project.
        
MISCELLANEOUS:
6a. New forms are required by law.  Mr. Askew distributed the new Request for Review form and notification to abutters to commission members for review.  
Mr. Avery has come across a form that requires town agencies to sign off on requests to ensure all have reviewed the matter.  He will make it available for members to consider.
6b. The wild and scenic committee will meet with the town manager, development planner and watershed representative on December 10, 2009.  
6c. Chairman Tolli distributed hand-outs from the CACIWC meeting.  

ANY OTHER PROPER BUSINESS:

Mr. Eric Lukingbeal has submitted his resignation from the commission.  He is now a member of the Planning and Zoning Commission.

ON A MOTION by Mr. Martindale, seconded by Mr. Kraner, the commission reluctantly accepts Mr. Lukingbeal’s resignation and offers their appreciation for a job well done.

The next monthly meeting is January 13, 2010 at 7:00 p.m. in the Town Hall meeting room.

ON A MOTION by Mr. Martindale, seconded by Mr. Katan, the commission voted to adjourn the meeting at 9:30 p.m.
