PLANNING AND ZONING COMMISSION
FEBRUARY 22, 2011
MINUTES

Present:  Paula Johnson, Chairwoman, Charles Kraiza, Paul Lambert, Eric Lukingbeal, James Sansone and Linda Spevacek.  Francis Armentano, Director of Community Development was also in attendance.

The meeting opened at 7:01 p.m.

Public session:
Don Butler, 134 Hungary Road, stated that he and his wife were hoping that a zoning amendment might be approved that would allow an accessory apartment within a detached building. He handed out a written request that included a suggested alteration to the Zoning Regulations. Fran pointed out that the Accessory Apartment regulations require that such apartments be attached to the existing home and that an amendment would be necessary if the Commission wanted to permit apartments in buildings that were not attached to the existing home. The Commission asked Fran to review the matter and report back to the Commission at the next meeting.

ON A MOTION by Linda Spevacek, seconded by James Sansone, the Commission voted to approve the minutes of the February 8, 2011 meeting.  All approved.  Eric Lukingbeal abstained.

Public hearing:
The public hearing for an application seeking a Special Permit for personal services under Section 3.12.1 of the Zoning Regulations for the use of property located at 9 Bank Street (Geisslers Plaza) for a nail salon, File Z-2-11, opened at 7:07 p.m. Jiawn Chong owner of the Granby Chinese Restaurant, stated that he and his wife are proposing to open a nail & spa salon for manicures, pedicures & waxing.  The tenant space is between the Subway and the Hardware Store and contains 1,000 square feet of space.  Mr. Chong reviewed the floor plan noting there is a manicure and pedicure area along with a waxing and facial room.  The location is connected to public water/sewer.  The site is subject to a unified sign plan.  The hours of operation are Monday – Friday 9:00 a.m. – 7:00 p.m., Saturday and Sunday 10:00 a.m. – 5:30 p.m.  The Commission suggested Fran work with the applicants to assure that the sign is designed in accordance with the sign plan.  The public hearing closed at 7:12 p.m.

Old Business:  
The Commission held a discussion with Liz Bennett concerning the conditions of the Special Permit issued for property located at 59 Meadow Brook Road, Bandit’s Place, Inc., File Z-01-11.  Ms. Bennett addressed her concerns for various conditions that were attached to the approval. The Commission members felt that the conditions were designed to protect the neighborhood, but agreed that they might consider changes provided a proper site plan was submitted that clearly showed the design of the building,
building placement on the lot and parking area. Ms. Bennett also mentioned she is looking into the possibility of another location.

New Business:
Michael Grillo, Tire King 541 Salmon Brook Street, has requested an informal discussion with the Commission to discuss adding another building to this site.

Fran noted there have been articles in the Valley News and other local publications concerning Scenic Roads.

Receive applications:
Proposed subdivision application for property located at 69 Hartford Avenue seeking to create 12 residential building lots.  Hearing to be held on March 22, 2011.

Staff Reports and Correspondence:
The Hunt Glen Developer is requesting the release of the security agreement for the property.

ON A MOTION by Eric Lukingbeal, seconded by Paul Lambert, the Commission voted to approve an application seeking a Special Permit for personal services under Section 3.12.1 of the Zoning Regulations for the use of property located at 9 Bank Street, (Geisslers Plaza) for a nail salon, as presented. File Z-2-11.     All approved.

The meeting adjourned at 7:55 p.m.
