MINUTES
Present: Paula Johnson, Chairwoman, Charles Kraiza, Paul Lambert, Eric Lukingbeal, James Sansone and Linda Spevacek. Francis Armentano, Director of Community Development and Kevin Clark, Town Engineer were also in attendance.
The meeting opened at 7:02 p.m.
Public session: There was no public comment.
ON A MOTION by Linda Spevacek, seconded by Eric Lukingbeal, the Commission voted to approve the minutes of March 22, 2011. All approved. Charles Kraiza abstained.
Public hearing:
The public hearing for an application by State Line Propane located at 500 Salmon Brook Street seeking a site plan modification and Special Permit to place an additional 30,000-gallon propane tank underground on the site, opened at 7:05 p.m. Jim Sansone recused himself from the discussion. Richard Lavengood, Relco Engineer and Environmental Consultant representing State Line Propane, noted that State Line Propane has been operating at this site for 3 years without incident or concern. Due to seasonal distribution and delivery issues of propane fuel, a second 30,000-gallon tank is proposed. This second tank will more adequately protect the public from spot shortages and provide for more efficient and consistent distribution of the product. The proposed tank will be approximately 5 feet away from the
existing tank with two loading stations. The site design will remain the same and there will be no modifications to the traffic flow. Mr. Lavengood gave a very informative presentation on the tank construction, emergency shutoff valves/switches, backup systems, safety codes and safety analysis. Michael Morrisey, Connecticut Director of the National Propane Gas Association reviewed CT Fire Safety Codes/Standards and commented that nationwide there have been no major mishaps or problems where tanks have been installed as proposed here. Joe Killen, Fire Marshall, noted that he met with Chief John Horr, Bill Volovski, Brian Guarco and Richard Lavengood in regards to this matter. Mr. Killen noted that all safety standards have been met and most exceed state requirements. He also noted that there haven’t been any complaints regarding this site or its operation. A letter prepared by Joe Killen on this matter is included in the subject file. It was also noted that the Lost Acres
Fire Department has received the proper training for this type of facility should a mishap occur. There was no public comment. The public hearing closed at 7:34 p.m.
Old Business:
The Commission held a discussion on an application seeking approval to subdivide property located at 69 Hartford Avenue into 12 residential building lots together with the proposed construction of a new town road that will be approximately 800 feet in length. File P-2-11. Eric Lukingbeal excused himself from the discussion and left the Commission table. Jim Sansone stated he was not prepared to vote, as he has not received a full set of scaled drawings. The Commission will continue their discussion of this application at the next meeting.
Eric Lukingbeal returned to the Commission table.
New Business:
Attorney Len Jacobs, representing Hunt Glen Granby LLC sought the Commission’s consensus that the establishment of a separate 6.17 acres parcel, to the rear of Mill Pond Drive, was in accordance with the ED zone, Section 3.9.4.14. Attorney Jacobs described the parcel and presented a survey of it. He discussed the 10 acre requirement and the opportunity to create lots within the ED zone that have less area and frontage where such lots conform to special criteria unique to the ED zone. The criteria included a separating distance of 500 feet from Salmon Brook Street and Floydville Road and access on a new town road. Fran Armentano further explained the criteria, noting the goal of reducing curb cuts along Salmon Brook Street and Floydville Road. He agreed that Mill Pond Drive constituted a new
town road under this section of the regulation. The establishment of this property as a separate lot is not a subdivision, as the final result is only 2 separate lots. Therefore, as no subdivision or other formal application is required, Hunt Glen Granby LLC, through their Attorney Len Jacobs, asks that the Commission find that the proposed lot complies with Section 3.9.4.14 of the Zoning Regulations. The Commission was very clear that they expected any future application of the property to include an extension of Mill Pond Drive through the property to accommodate future development within the ED zone. Mill Pond Drive was originally designed and approved as a future connecting road.
ON A MOTION by Paul Lambert, seconded by Linda Spevacek, the Commission voted to approve the request to create a separate lot within an ED Zone in accordance with Section 3.9.4.14 of the Zoning Regulations. All approved.
The Commission held a brief discussion concerning accessory apartments in detached buildings and found no reason to move forward with this issue at this time.
There was no discussion concerning Ridge Lines at this time.
Receive Applications:
The Commission received an application seeking site plan approval for property located at 29 Hartford Avenue. The application proposes to add 384 square feet to an existing building, File Z-5-11.
Staff Reports and Correspondence:
Fran did not report on any addition matters at this time.
Commission discussion of items of interest or concern:
There was no discussion.
ON A MOTION by Eric Lukingbeal, seconded by Paul Lambert, the Commission voted to approve an application by State Line Propane located at 500 Salmon Brook Street seeking a site plan modification and Special Permit to place an additional 30,000 gallon propane tank underground on the site as proposed. The Commission noted that all previous conditions attached to their approval of an application for this site, dated November 23, 2004 and known as File Z-21-04, shall remain in force. All approved.
Jim Sansone did not participate in the discussion or the vote as he previously recused himself from this matter.
