PLANNING AND ZONING COMMISSION
JANUARY 27, 2004
MINUTES

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Community Development and Edward Sweeney, Town Engineer.

The meeting opened at 7:01 p.m.

Public session:  Carolyn Flint informed the Commission and the public that the Conservation Commission is moving ahead with past projects, current issues and concerns.

ON A MOTION by Put Brown, seconded by Linda Spevacek, the Commission voted to approve the minutes of December 9, 2003 with the following correction:  Page 3, paragraph 1, sentence 1, Pub Brown should be Put Brown.  All approved.  Charles Kraiza and James Sansone abstained.

Public hearing on an application for a Special Permit for a garage in excess of 600 square feet for property located at 2 Becontree Heath Road, File Z-1-04, opened at 7:06 p.m.  Bud Murtha, representing Thomas Sorgio, presented a plan for the 1,792 square foot building.  Mr. Murtha stated that the proposed building would be designed to match the existing house.  The garage would be of wood frame construction, with a pitched roof, an oversized door; clapboard siding and a shingled roof.  The building would be used for the storage of Mr. Sorgio’s collection of antique cars and boats.  Local neighbors expressed concerns regarding the size of the building in a residential neighborhood, possibility of an auto repair shop or used car sales, visibility, noise, contamination of ground water from the maintenance and storage of a large number of vehicles, property values, resale, ownership by a LLC, increased traffic and safety.  A Becontree Heath resident referenced the possibility of a Homeowners Association with deed restrictions and covenants and voting on the issue by residents. A letter was received from Mr. Stenikinas for the file.  Public hearing closed at 7:49 p.m.

Public hearing on an application seeking s site plan for outside storage for property located at 516 and 516R Salmon Brook Street, Z-2-04, opened at 7:50 p.m.  Doug Max, Maximum Tree Service and owner, presented a site plan indicating the areas where various wood products would be stored.  Mr. Max stated that he recently purchased the property at 516R Salmon Brook Street.  He would now like to start to use all of his property for the storage of wood chips, logs and tree length firewood.  The location of these materials will be in various areas as shown on the map.  Mr. Max also indicated he is currently seeking bids for the construction of a building.  An abutting neighbor expressed concern for decaying woodchips that might be hazardous, the volume of wood chips stored, noise and storage areas.  Another neighbor questioned the length of time that the materials would be stored.  Public hearing closed at 8:12 p.m.

Public hearing on an application for an amendment to the Zoning Regulations, Section 10.2.5.2, concerning the public notice process for applications that propose a change of zone, File Z-28-03, opened at 8:13 p.m.  Fran Armentano reviewed the proposed changes with the Commission and expressed the need to make a greater effort to inform the public of zone change applications.  Fran also stated he has received positive comments from the public concerning this amendment.  Members of the public encouraged the Commission to adopt the amendment.  A letter was received from the Capitol Region Council of Governments for the file.  Public hearing closed at 8:19 p.m.

The Commission held an informal discussion with John Griffey of Dunkin Donuts concerning Drive Through Windows.  Mr. Griffey reminded the Commission that he came before them 2 years ago and would like to revisit the issue.  He stated that Dunkin Donuts might lease a storefront in a building currently under construction on Mill Pond Road.  He feels the public would be better served if they could purchase coffee and other items from their vehicles.  He proposes a regulation that will limit the amount of prepared food that can be sold from the window.  Mr. Griffey and the Commission discussed hours of operation, speaker system, volume of business, liter and distance from a residential zone.

The Commission received an application for Special Permit for property located at 357 Salmon Brook Street, Cambridge House, Brew Pub.  Public hearing is scheduled for February 10, 2004.

The Commission discussed the appointment of a representative to serve on the CRCOG Regional Planning Commission.

Chairwoman Johnson reviewed the Subcommittee status and stated current members of the Architectural Review Board are John Morgan, Mike Wosczyna, Lori DiBattisto, Terry-Ann Hahn and volunteers are needed.

Chairwoman Johnson appointed Peg Chapple as head of a new Sign Subcommittee.

The Commission held a brief discussion concerning the Special Permit for a garage in excess of 600 square feet for property located at 2 Becontree Heath Road, File Z-1-04.  The consensus of opinion was the Commission members would like to visit the area before a decision is made.

ON A MOTION by Charles Kraiza, seconded by Fred Wilhelm, the Commission voted to approve an application seeking a site plan for outside storage for property located at 516 and 516R Salmon Brook Street, Z-2-04.  All approved. The Commission found that the application was in compliance with the regulations.


ON A MOTION by Margaret Chapple, seconded by Charles Kraiza, the Commission voted to approve an application for an amendment to the Zoning Regulations, Section 10.2.5.2, concerning the public notice process for applications that propose a change of zone, File Z-28-03.  All approved. The Commission found that the change was supported by State Statute and in the best interest of the community.

The meeting adjourned at 9:00 p.m.
