MINUTES
Present: Paula Johnson, Chairwoman, Margaret Chapple, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Director Of Community Development and Edward Sweeney, Town Engineer.
The meeting opened at 7:04 p.m.
Public session: There was no public comment.
ON A MOTION by James Sansone, seconded by Fred Wilhelm, the Commission voted to approve the minutes of February 24, 2004. All approved.
Margaret Chapple entered at 7:05 p.m.
Public hearing on an application for an amendment to Section 8.16.1 concerning drive-through windows, File Z-4-04, opened at 7:05 p.m. John Griffey, applicant, gave a brief overview of the January 2004 informal discussion. Mr. Griffey discussed his desire to have a drive-through window for a proposed Dunkin Donuts. He discussed how a coffee shop was different from a restaurant and why the drive-through window regulations should differentiate between the uses. The amendment would allow the Commission to consider a drive-through window for restaurants that sell very little cooked or prepared foods. The amendment reduces the separation of a drive-through window from a residential zone from 1000 feet to 200 feet. In response to a Commission concern, Mr. Griffey discussed the sound system that
would be used at the drive-through window. He stated that there are separate day and evening volumes and that the sound is not heard beyond 50 feet. In response to traffic concerns, Mr. Griffey referenced State Department of Transportation findings. He presented traffic statistics from his New Hartford store. The file contains the comments from the Capital Region Council of Governments. Members of the public opposed the amendment. The public hearing closed at 7:52 p.m.
Public hearing on an application for special permit for use within an Aquifer Protection Overlay Zone for property at 7 Mill Pond Drive, File Z-5-04, opened at 7:53 p.m. Mark Sack, owner, stated that Movie Gallery hopes to be a tenant at this location. The site and building plans were previously approved and found to be in compliance with the aquifer regulations. Movie Gallery is a business that rents and sells video entertainment merchandise, primarily DVD and VHS movies and games. Mr. Sack stated that such businesses present little or no negative impact on the aquifer. There was no written communications or public comment. The public hearing closed at 7:55 p.m.
Bruce and Corey Unger, 188 Salmon Brook Street, owners of Old Farms Landscaping, held an informal discussion with the Commission. Working with Fran Armentano they drafted an amendment that will allow Residential Landscape Businesses by Special Permit within residential zones. The Commission appeared to support the concept and agreed to become responsible for the continuing work on the amendment. The proposed amendment will be referred to CRCOG for comment and the Commission will discuss it in greater detail at the next meeting.
The Commission may receive an application for site plan and special permit for property at 9 Mill Pond Drive, File Z-6-04, at their March 23rd meeting.
ON A MOTION by Fred Wilhelm, seconded by Linda Spevacek, the Commission voted on an application for special permit for use within an Aquifer Protection Overlay Zone for property at 7 Mill Pond Drive, File Z-5-04. All approved. The Commission found the request to be in conformance with the regulations.
The Commission briefly discussed the application for an amendment to Section 8.16.1 concerning drive through windows, File Z-4-04, and will continue to discuss the matter at the next meeting.
