PLANNING AND ZONING COMMISSION
APRIL 27, 2004
MINUTES

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, and Edward Sweeney, Town Engineer.

The meeting opened at 7:05 p.m.

Public session:  There was no public comment.

ON A MOTION by Linda Spevacek, seconded by Fred Wilhelm, the Commission voted to approve the minutes of April 13, 2004.  All approved.

The continuation of a public hearing on a Special Permit for an accessory apartment in accordance with Section 8.5 of the Zoning Regulations for property located at 198R Salmon Brook Street, File Z-8-04, resumed at 7:06 p.m.  Frank Bogli, applicant, presented to the Commission additional renderings indicating the attachment of the proposed accessory apartment to the existing garage.  Mr. Bogli, stated the proposed accessory apartment would be dependant upon the main building. There will be a separate furnace using the same fuel source as the main house and one electrical meter.  The accessory apartment will share the existing public water and sewer line with the existing house.  The unit will be on the same level as the main house entering through the garage. There was no additional public comment at this meeting.  The public hearing closed at 7:13 p.m.

The Commission held a lengthy discussion concerning Draft 2 of a comprehensive Dedication of Open Space amendment to the Subdivision Regulations.  The amendment includes a fee in lieu of open space provision.  The Commission members made a variety of suggestions and the draft will be further discussed at a future meeting.

Public hearing on a proposed amendment to allow Residential Landscape Businesses by Special Permit is set for May 11, 2004.

ON A MOTION by Fred Wilhelm, seconded Charles Kraiza, the Commission voted to approve a Special Permit for an accessory apartment in accordance with Section 8.5 of the Zoning Regulations, for property located at 198R Salmon Brook Street, File Z-8-04, with the following conditions:

1.      Construction must commence within one year or the permit is null and void.
2.      The apartment may only be used by the relatives of the property owner as presented in the application.
3.      The applicant agrees to allow the Zoning Enforcement Officer to inspect the building on an annual basis to verify compliance with the requirements of Section 8.5 and the conditions outlined herein.
4.      The property shall be considered to be, and shall be used as, a single-family residence.
5.      The entire structure shall be metered by one common electrical service and a common fuel source.
6.      The owner of the property shall reside on the property throughout the duration of the permit.

The Commission advised the applicant that the specific placement of the accessory apartment must be in compliance with the rear lot, yard requirements of Section 8.14 of the Zoning Regulations.

The motion was approved 5-1.  Paula Johnson, Put Brown, Charles Kraiza, James Sansone, Fred Wilhelm approved.  Linda Spevacek opposed.  The Commission members voting in favor of the application found it to be in compliance with Section 8.5 of the Zoning Regulations.

The meeting adjourned at 8:14 p.m.
