PLANNING AND ZONING COMMISSION
May 11, 2004
MINUTES

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm and Francis Armentano, Director Of Community Development.

The meeting opened at 7:04 p.m.

Public session:  There was no public comment.

ON A MOTION by Jim Sansone, seconded by Fred Wilhelm, the Commission voted to approve the minutes of April 27, 2004.  All approved, Peggy Chapple abstained.

Public hearing on an application for a Special Permit for a Day Spa and use within an Aquifer Protection Overlay Zone for property located at 7 Mill Pond Drive, file Z-10-04, opened at 7:05 p.m.  Greg Maglieri, property owner, presented the application to the Commission. He described the Day Spa.  This will involve services such as hair treatments, massage, tanning, manicures, facials, and similar personal services.  No one from the public elected to speak on this matter and the hearing closed at 7:08 p.m.

Charlie Kraiza entered at 7:12 p.m.

Public hearing on an application for a Special Permit in accordance with Section 8.1.3.4 of the Zoning Regulations for a garage in excess of 1,000 square feet, property located at 2 Becontree Heath, file Z-11-04, opened at 7:09 p.m.  Bruce Murtha presented the application to the Commission.  Proposed is a 1,536 (48x32) square foot garage.  The garage is of wood frame with a pitched roof and a 12x12 garage door.  The garage will be approximately 100 feet from both Becontree Heath and Donahue Road and will be partially screened by existing vegetation.  The building will be used to store a collection of antique cars and boats.  The Commission and the applicant discussed in detail the proposed height, design and the screening of the garage.  Mr. Murtha presented a list of Becontree Heath residents who supported the project and noted 2 who did not support it.  Public comment was mixed, with the opponents voicing concern for the size, location and appropriateness of the garage.  The hearing closed at 7:39 p.m.

Public hearing on an application for an amendment to the Zoning Regulations that proposes the addition of new Section 8.28, Residential Landscape Business, file Z-6-04, opened at 7:40 p.m.  Fran Armentano presented the application along with Cory Unger.  This amendment was first initiated by the Ungers’.  After the preliminary discussions with the Commission, Fran Armentano worked cooperatively with the Ungers’ to produce an amendment that could serve the whole community.  The amendments allow an applicant to apply for a landscape business within a residential zone, where the business exceeds the limitations of a home occupation.  Various concerns were expressed during the public hearing.  Some of the speakers appeared to live in close proximity to landscape operations that may be operating beyond the scope of a home occupation.  The Commission explained that a goal of the amendment was to aid in such situations.  The hearing was continued to the May 25, 2004 meeting in order to receive comments from the Capitol Region Council of Governments.

The Commission held an informal discussion with Tom Fredo and Leonard Bull regarding property located at 379 North Granby Road.  Tom Fredo is the owner of the property and Len Bull currently uses it and is considering purchasing it.  The property is in a C2 Zone and Mr. Bull would like to use it for the outside storage and sale of materials such as top soil, sand, stone, bark mulch and similar materials.  The Commission noted the existing condition of the property and suggested that it should be cleaned up.  The members further suggested that the use could be appropriate, but reserved further comment until they could view a specific site and use plan, together with the appropriate buffering of the neighboring property.

The Commission discussed the latest draft of a comprehensive Dedication of Open Space amendment to the Subdivision Regulations.  The amendment includes a fee in lieu of open space provision.  Fran Armentano explained the reasoning behind various sections of the draft and the limitations on the wording in the fee in lieu provision.  The Commission hopes to have a public hearing on the matter in June.  Fran will e-mail copies to the members who may suggest further modifications.

The Commission discussed a proposed Town Ordinance which would designate the Planning and Zoning Commission as the Town’s Aquifer Protection Agency.  The agency is a requirement under Connecticut General Statutes, Section 22a-354i.  Fran Armentano explained the proposed action.  It is likely that the agency will not become fully functional until 2007 or later.

The Commission received an application for a Special Permit for a garage in excess of 600 square feet for property located 2 West Lakeview Drive, file Z-12-04.  A public hearing on the matter will be held on May 25, 2004.

The Commission clarified their action of April 13, 2004 regarding the special permit for property at 9 Mill Pond Road, file Z-7-04.  Condition #1 should read:

1.      This Special Permit provides for the Construction of the site and the building as proposed and the use of one storefront for a Drop Off Cleaners as presented at the public hearing.  No on-site [insert the word DRY] cleaning is approved for the property and future commercial tenants must receive Commission approval prior to occupancy, as required in the Aquifer Protection Overlay Zone regulations.

ON A MOTION by Fred Wilhelm, seconded Margaret Chapple, the Commission voted to approve a Special Permit for a Day Spa and use within an Aquifer Protection Overlay Zone for property located at 7 Mill Pond Drive, file Z-10-04.  All approved as the Commission found that the request was in compliance with the regulations.  Charlie Kraiza abstained.

ON A MOTION by Put Brown, seconded by Jim Sansone the Commission voted to approve an application for a Special Permit in accordance with Section 8.1.3.4 of the Zoning Regulations for a garage in excess of 1,000 square feet, property located at 2 Becontree Heath, file Z-11-04 with the following conditions:

1.      The applicant shall install up to 20 trees, of a type, a size and in locations as may be required to screen the garage from neighboring areas, as directed by the Director of Community Development.

2.      The structure will be used solely as an accessory to the primary residential use of the property and shall not be used for commercial purposes.

All approved as the Commission found that the proposal, as conditioned, was in compliance with the regulations.  Charlie Kraiza abstained.

The meeting adjourned at 9:10 p.m.
