MINUTES
Present: Paula Johnson, Chairwoman: Daniel P. Brown, Jr., Margaret Chapple, James Sansone, Linda Spevacek, Frederick Wilhelm and Francis Armentano, Director Community Development.
The meeting opened at 7:05 p.m.
Public session: Robert Schlicht, 114 East Street, presented a previously approved subdivision lot, known as 7 Cooley Road. Mr. Schlicht stated he would now like to build on this piece of property. He inquired as to the process to relocate the conservation easement or the open space area to allow for better use of the property and to avoid the 100 foot Wetland buffer area. The Commission informed Mr. Schlicht that he would need to seek a resubdivision for the property.
ON A MOTION by Put Brown, seconded by Margaret Chapple, the Commission voted to approve the minutes of May 25, 2004. All approved. Linda Spevacek abstained.
Public hearing on an amendment to the Subdivision Regulations, Sections 3.1.3 and 3.1.4 concerning the preservation of open space, the quality, type and location of the open space, preservation methods, the inclusion of a fee in Lieu of Open Space Dedication provision and other changes to these sections, File P-1-04, opened at 7:12 p.m. Fran gave an overview of the modifications of a comprehensive dedication of open space requirement, including fee in lieu of open space for the Subdivision Regulations. The restructuring of the regulation would allow for a higher quality of land. There was no public comment. The public hearing closed at 7:21 p.m.
The Commission held a lengthy discussion and revised the proposed draft of an application for an amendment to the Zoning Regulations proposing the addition of new Section 8.28 Residential Landscape Business, File Z-6-04.
ON A MOTION by Fred Wilhelm, seconded by Margaret Chapple, the Commission voted to approve an application for an amendment to the Zoning Regulations, proposing the addition of new Section 8.28 Residential Landscape Business, File Z-6-04. All members voted to approve. The Commission found, that as modified, the amendment will preserve the residential character of the community while creating a mechanism for review, oversight and registration of landscape businesses. The amendment conforms to the Plan of Conservation and Development and the overall purpose of the Zoning Regulations. (The amendment is attached to these minutes.)
The Commission held an informal discussion with Brian Guarco concerning a site development plan for property located to the south of the State Line Oil buildings. Mr. Guarco stated a new lot would be separated from the existing 12.5 acre piece of property
to allow for a separate propane business. He submitted renderings of the proposed building that would be used for office space, service dispatch, showroom, warehouse and storage of air conditioning equipment. A 7-foot high wire fence would enclose the storage area for the 18,000-gallon and 36,000 gallon tanks. The Commission discussed various design issues and agreed that the depth of the Visual Streetscape Buffer could be as shown, to allow greater separation and buffering for the residential properties to the rear of the site. However, the Commission insisted on a quality planting plan for the front of the building.
Fran Armentano provided the Commission with a brief update on DEP’s Aquifer Protection Regulations.
Applications received:
1. An application for a Special Permit for a garage in excess of 600 square feet, for property located at 199 Simsbury Road. File Z-13-04.
2. An application for a Special Permit for a Rear lot Subdivision that proposes one additional lot for property located at 49 Buttles Road. File Z-12-04.
ON A MOTION by Put Brown, seconded by Fred Wilhelm, the Commission voted to approve, as modified, an amendment to the Subdivision Regulations, Sections 3.1.3 and 3.1.4 concerning the preservation of open space, the quality, type and location of the open space, preservation methods, the inclusion of a Fee in Lieu of Open Space Dedication provision and other changes to these sections, File P-1-04. All approved as the Commission found that the amendment was in conformance with the Plan of Conservation and Development, State Statute, the purpose of the Subdivision Regulations and that it will aid in preserving the rural character and natural landscape of the Town.
