JUNE 22, 2004
MINUTES


Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm and Francis Armentano, Director, Community Development.

The meeting opened at 7:01 p.m.

Public session:  There was no public comment.

ON A MOTION by James Sansone, seconded by Fred Wilhelm, the Commission voted to approve the minutes of June 8, 2004.  All approved.  Charles Kraiza abstained.

Public hearing on an application for a Special Permit for a barn in excess of 600 square feet, for property located at 199 Simsbury Road, File Z-13-04, was held later in the evening, as the applicant was not in attendance at that time.

Public hearing on an application for a Special Permit for a Rear Lot Subdivision that proposes one additional lot for property located at 49 Buttles Road, File Z-12-04, opened at 7:05 p.m.  Stanley Szestowicki, Surveyor, representing David Carlson, presented the plans for the rear lot.  The plans show the property being divided into 2 lots, lot A containing .69 acres and lot B, the rear lot containing 2.4-acres.  The owner, Mr. Carlson, proposes to build a new home of approximately 4,000 square feet.  The soil conditions are excellent in this area and are well suited for an on site well and septic system.  Approval has been received from Farmington Valley Health District.  It appears that the most of the trees were recently cleared from the site.  Little or no vegetative buffer remains on the proposed rear lot.  The Commission expressed great concern regarding the clearing of the land prior to the Planning and Zoning Commissions consideration of this application.  The Commission found that the plan provided no useful information regarding the establishment of a buffer.  Neighboring property owners, who reside on Halwood Drive, and whose rear yards abut the proposed rear lot, expressed various concerns.  The primary concern appeared to be the removal of the trees and the resulting impact on wildlife and privacy.  Other comments were expressed in regards to the septic system, property values, drainage, number of lots, placement of existing sheds, maintenance of this property and what types of screening will be along the boundaries.  The public hearing will continue on July 13, 2004 to allow Mr. Carlson time to prepare a landscaping plan designed to improve the buffering of the existing homes from the proposed rear lot.  The file contains a letter and photos from Colleen Hannon of 12 Halwood Drive.  The public hearing adjourned at 7:52 p.m.


Public hearing on an application for a Special Permit for a barn in excess of 600 square feet, for property located at 199 Simsbury Road, File Z-13-04, opened at 7:53 p.m.  Margaret Campbell, owner, submitted a picture of the proposed 600 square foot barn and stated they have 2.6 acres and that there is no intention to remove any of the natural barriers.  The barn would allow them to keep their horses on this property.  Their horses are currently boarded across the street.  There was no public comment.  Public hearing closed at 7:59 p.m.

The Commission held a discussion concerning Mill Pond Drive Subdivision.  Fran reviewed the approval of this subdivision, the existing bond and various concerns that have arisen.  He informed the Commission members that the owner has expressed a reluctance to deed the road to the Town as approved.  The subdivision has exceeded the 5 year completion requirement and is 99% complete.  Only the execution of the final deeds and some minor public improvements remain to be completed.  The Commission directed Mr. Armentano to immediately refer the matter to the Town Attorney.  

The Commission received applications for the following:

1.      An application for Special Permit for a sandwich shop and a coffee shop for property located at 7 Mill Pond Drive. File Z-15-04.

2.      An application for Site Development Plan for property located to the rear of the State Line Oil Company and north of West Lakeview Drive, along a ROW know as Manitook Road and known as at 516 and 516R Salmon Brook Street. File Z-16-04.

3.      An application for Site Development Plan for property located to the south of the State line Oil buildings, 514 Salmon Brook Street. File Z-17-04.

4.      An application for a Site Plan Amendment seeking to add parking at the YMCA, Salmon Brook Street. File Z-18-04.

The Commission received correspondence regarding the pending acceptance of Strawberry Fields Road and the completion of other subdivisions.  Comments included a variety of items that would have to be completed prior to final acceptance.  One particular comment was of concern to the Commission members.  It was noted that double yellow lines had to be painted along Strawberry Fields Road.


ON A MOTION by Put Brown, seconded by Margaret Chapple, the Commission voted to strongly recommend that double yellow lines not be painted on cul-de-sac roads.  The Commission believes that such markings are not wanted by the residents, can have a negative effect on property values, encourage vehicular speeding, are unsightly and add an urban feel to rural neighborhoods.  All approved.

ON A MOTION by Charles Kraiza, seconded by Fred Wilhelm, the Commission voted to approve an application for a Special Permit for a barn in excess of 600 square feet for property located at 199 Simsbury Road, File Z-13-04.  All approved.

ON A MOTION by Margaret Chapple, seconded by James Sansone, the Commission voted to go into Executive Session with Town Staff in attendance.  All approved.

ON A MOTION by Margaret Chapple, seconded by James Sansone, the Commission voted to end the Executive Session.  All approved.

The meeting adjourned at 8.27 p.m.
