July 13, 2004
MINUTES

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, James Sansone, Linda Spevacek, Charles Kraiza, Frederick Wilhelm, Francis Armentano, Director Of Community Development and Edward Sweeney, Town Engineer.

The meeting opened at 7:02 p.m.

Public session:  There was no public comment.

ON A MOTION by James Sansone, seconded by Charles Kraiza, the Commission voted to approve the minutes of June 22, 2004 with the following correction:  Page 1, paragraph 6, last sentence should read, The public hearing adjourned at 7:52 p.m. to be continued July 13, 2004.  Page 3, paragraph 3, should read, ON A MOTION by Margaret Chapple, seconded by James Sansone, the Commission voted to go into Executive Session with Town Staff in attendance for the purpose of discussing pending litigation.  All approved.

Continuation of a public hearing on an application for a Special Permit for a Rear Lot Subdivision that proposes one additional lot for property located at 49 Buttles Road, File Z-14-04, opened at 7:05 p.m.  Stan Szestowicki, Surveyor, submitted revised planting plans and a minor change to the lot dimensions.  Fran informed the Commission that he walked the area and suggested the addition of various trees and shrubs for buffering, as requested by the Commission.  Mr. Carlson stated that he talked to abutting neighbors concerning the buffer area.  A letter was read into the minutes from Dennis Campbell stating that he did not want a vegetative buffer on the side of the driveway.  Colleen Hannon, 12 Halwood Drive and Penny Gitberg, 6 Halwood Drive, abutting neighbors, again expressed concern for the types of screening, maintenance, completion and enforcement of the project.  Public hearing closed at 7:35 p.m.

Public hearing on an application for Special Permit for a sandwich shop and a coffee shop for property located at 7 Mill Pond Drive, File Z-15-04, opened at 7:37 p.m.  Mark Sack, owner, reviewed the locations of the units on the existing site plan for the prospective new tenants, Blimpie and Dunkin Donuts.  All improvements will be to the interior of the building only.  There was no public comment.  Public hearing closed at 7:44 p.m.

Public hearing on an application for Special Permit and Site Development Plan for property located to the rear of the State Line Oil Company and north of West Lakeview Drive, along a ROW know as Manitook Road and known as at 516 and 516R Salmon Brook Street, File Z-16-04, opened at 7:45 p.m.  Kevin Clark, Engineer, reviewed the site plan with the Commission.  Mr. Clark stated that this is a 2.69-acre parcel. The land is fairly flat, with an open gravel surface surrounded by a planted berm with no areas of wetlands.  Mr. Max, owner, reviewed his plans to build a 12,000 square foot building.  The building will include 1,250 square feet of office space and 11,375 square feet for warehouse open space and future tenants.  The building is in an industrial zone and it will not be visible from the road.  The presenters also reviewed the dumpster location, lighting and hours of operation.  A letter has been received from Farmington Valley Health District stating that the soils are suitable for well and septic systems.  Local neighbors expressed concern for the location of the dumpster and requested the Commission’s approval include the relevant conditions outlined within the Declaration of Restrictions and Covenants that exists between the property and the adjacent Manitook Lakes Association.  Public hearing closed at 8:20 p.m.

Public hearing on an application for Special Permit and Site Development Plan for property located to the south of the State Line Oil building, 514 Salmon Brook Street, File Z-17-04, opened at 8:21 p.m.  The Commission suggested the public hearing be continued to allow the applicant time to complete all aspects of the application and to allow the public and staff ample time to review the newly filed materials.  The hearing was continued to the July 27, 2004 meeting.

ON A MOTION by Linda Spevacek, seconded by James Sansone, the Commission voted to approve an application for a Special Permit for a Rear Lot Subdivision that proposed one additional lot for property located at 49 Buttles Road as outlined on a plan titled Vegetation Preservation/Planting Plan dated June 14, 2004, revised July 8, 2004 and Rear Lot Subdivision Plan dated June 3, 2004, as revised, with the following conditions:

1.      The planting plan must be completed, prior to the issuance of a Certificate of Occupancy for the new home.  The planting plan should be installed together with the installation of the septic system and the construction of the home.  If the planting plan is interrupted due to the onset of the winter season a C of O may be issued, upon recommendation of the Director of Community Development, if an adequate bond is filed to guarantee the completion of the plantings.

2.      The planting plan shall be modified by changing the proposed Dwarf Burning Bushes to Northern White Cedars and by including the planting of 4 additional White Pine trees at a minimum of 15 feet in height.

3.      The driveway must be paved with bituminous concrete, beginning at Buttles Road and extending a minimum of 150 feet back towards the proposed home.

ON A MOTION by Fred Wilhelm, seconded by Charles Kraiza, the Commission voted to approve an application for Special Permit of a sandwich shop and a coffee shop for property located at 7 Mill Pond Drive, File Z-15-04, as proposed.  All approved.

ON A MOTION by Charles Kraiza, seconded by Fred Wilhelm, the Commission voted to approve an application for Special Permit and Site Development Plan for property located to the rear of the State Line Oil Company and north of West Lakeview Drive, along a ROW known as Manitook Road and known as 516 and 516R Salmon Brook Street, File Z-16-04, with the following conditions:

1.      No exterior pole lights are approved. The exterior of the site may only be illuminated by building mounted lighting fixtures. These lighting fixtures must be designed to concentrate light towards the Manitook Road ROW and away from the residential areas to the west and south.  No exterior site lighting fixtures shall be installed without the approval of the Director of Community Development.

2.      The dumpster location is approved, provided the size is limited to a maximum of 4 yards and provided that it is emptied on a “will call” basis and only between the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday.

3.      The Commission acknowledges a Declaration of Restrictions and Covenants, between the applicant, Doug Max and the Manitook Lake Association and includes in this approval the following items:

A.      The commercial use of the property shall be restricted to businesses such as landscapers, tree services, lawn services and other contractors whose primary occupation is the performing of services off site.  The property shall not be used commercially by any business whose primary occupation is the manufacture, repair or sale of goods on the premise.

B.      The existing berm on the Southern and Eastern borders of the property shall be maintained at their current heights.  Said berm shall be two-tiered, and shall be planted with arborvitae, forsythia, ficus and grass.  In addition, the property owner shall provide and maintain screenings and plantings between any building on the property and the residential property to the south and east of the property.

C.      No firewood processing, milling, cutting or chain sawing of logs shall occur on the property before the hour of 9:00 a.m., after the hour of 5:00 p.m., or at any time on weekends or holidays.

D.      No wood chipping shall be conducted on the property except as necessary for the maintenance of trees or other vegetation grown on the property itself.

E.      The outdoor use of chain saws shall be limited to a maximum of two (2) hours per day and five (5) hours per week, and shall occur only between the hours of 12:00 noon and 4:00 p.m.

F.      Nothing herein shall be construed to restrict the property or business owner from performing office operations inside the building (s) located on the property.

All approved as the Commission found the application, as conditioned, to be in conformance with the regulations.

The Commission received an application for a one lot resubdivision for property located at 249 Granville Road, File P-2-04.  A public hearing will be held on July 27, 2004.

The Commission received an application for a one lot resubdivision of #6 Appletree Lane, File Z-19-04.  A public hearing will be held on July 27, 2004.

The Commission received an application for a Site Plan amendment seeking to add parking at the YMCA, Salmon Brook Street. File Z-20-04.  A public hearing will be held on July 27, 2004.

All approved.

The meeting adjourned at 8:52 p.m.
