PLANNING AND ZONING COMMISSION
Minutes
September 28, 2004

Present: Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm and Francis Armentano, Director of Community Development.

The meeting opened at 7:08 p.m.

Public session:  There was no public comment.

ON A MOTION by Fred Wilhelm, seconded by Linda Spevacek, the Commission voted to approve the minutes of September 14, 2004.  All approved.   Charles Kraiza abstained.

A continuation of a public hearing on an application for Special Permit and Site Development Plan for State Line Propane, located to the south of the existing State Line Oil buildings, 514 Salmon Brook Street, File Z-21-04, resumed at 7:09 p.m.  Brian Guarco, owner, submitted a rendering of the building and floor plan along with samples of the roof and siding materials.  He went on to discuss a revised site plan.  Mr. Guarco stated that the major change in plan would be the elimination of the tanks that were proposed to be above ground.  The plan now identifies the placement of one 36,000-gallon propane tank under ground.  It was suggested that this change will eliminate Fire Marshal, John Oates’ concern regarding the requirement that the local fire department be able to provide the necessary six hundred gallons of water per minute, as required by the fire safety regulations.  Placing the tank underground will also eliminate the issue of the visibility of the tank. Mr. Guarco also discussed the exterior lighting and transfer and delivery vehicles and apparatus.  Richard Lavengood, Engineer, reviewed the site safety measures and discussed the shut off valve inside the tank.  Mr. Guarco discussed the location of the tank, the fence and the building.  The Commission directed the applicant to stakeout on the property the following areas to aid in their evaluation of the proposal:
·       The centerline of the proposed driveway, where it will intersect with Salmon Brook Street.
·       The 4 corners of the building
·       The front and back of the proposed propane tank (where it is to be buried)
·       The corners of the proposed fence
·       The front detention basin, the nearest point of excavation to the front tree line.
Neighbors expressed various concerns regarding truck traffic, safety, current lack of compliance with all state and local codes, curb cut location, property values, lighting, hours of operation, storage of empty tanks, fencing, noise, and similar issues.  Letters were submitted for the file from Vicky Latonie and Linda Knorr.  The public hearing will be continued on October 12, 2004 to allow time for the completion of the fire and safety analysis, lighting issues, Department of Transportation approval modifications to the map, staking of the site and to allow the Commission members time to re-visit the site.  The public hearing adjourned at 8:16 p.m.

A continuation of a public hearing on an application for Special Permit for a Residential Landscape Business for property located at 188 Salmon Brook Street, File Z-23-04, resumed at 8:18 p.m.  Applicants Bruce and Cory Unger submitted a map combining 186 and 188 Salmon Brook Street into one lot, to be known as 188 Salmon Brook Street and which contains their primary residence.  The existing curb cut will be used.  The applicants also reviewed the possible types and size of the proposed trees for the buffer area.  Various issues regarding the general use of the property for Landscape Residential Business were discussed.  There was no public comment.  The public hearing closed at 8:26 p.m.

ON A MOTION by Linda Spevacek, seconded by Margaret Chapple, the Commission voted to approve a 3-year extension for the completion of the required public improvements for  Cider Mill Heights Section III.
All approved.

The Commission received an application for:

An Amendment to Section 8.10 concerning a Bed and Breakfast or Inn Use, File Z-24-04.

A Special Permit for Personal Service and Use within an Aquifer Protection Overlay Zone, for property located at 345 Salmon Brook Street, File Z-25-04.

The meeting adjourned at 8:44 p.m.
