PLANNING AND ZONING COMMISSION
MINUTES
October 12, 2004

Present:        Paula Johnson, Chairwoman, Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, and Francis Armentano, Director of Community Development.

The meeting opened at 7:07 p.m.

Public session:  There was no public comment.

ON A MOTION by Charles Kraiza, seconded by Margaret Chapple, the Commission voted to approve the minutes of September 28, 2004.  All approved.

Continuation of a public hearing on an application for Special Permit and Site Development Plan for State Line Propane, located to the south of the existing State Line Oil buildings, 514 Salmon Brook Street, File Z-21-04, resumed at 7:08 p.m.  Christopher Stenson, Engineer, representing Brain Guarco, presented a revised site plan and reviewed with the Commission the significant changes.  The plan now identifies the placement of one 36,000-gallon propane tank underground to eliminate the concerns of the Fire Marshal regarding the fire safety regulations.  The grade of the site will be reduced to lower the profile of the site.  Mr. Guarco explained that the Department of Transportation is requiring that an existing catch basin be moved to the north and that a new basin be installed to the south as a condition of approval for the proposed curb cut.  To avoid this, the applicant proposes moving the curb cut to the south.  Bob Wosnewsky will be submitting the candlepower plan for the lighting analysis.  Fire Marshal, John Oates has submitted written concerns in regards to this application.  The consensus of the Commission members was that Mr. Oates should be in attendance at the next scheduled meeting regarding this application to help them understand the nature of these concerns.  Mr. Oates is unavailable until November, so the hearing will be continued to the November 9, 2004 meeting.  The public expressed safety concerns, asked if the application could be withdrawn, supported the attendance of the Fire Marshal, addressed property values and the possible non-compliance of the operation.  Linda Knorr submitted a letter for the file.  The public hearing will continue to November 9, 2004 to allow the applicant time to complete final modifications to the plan and to allow for the attendance of the Fire Marshal.  The public hearing adjourned at 7:41 p.m.

Public hearing on an application for a Special Permit for Personal Service and Use within an Aquifer Protection Overlay Zone, for property located at 345 Salmon Brook Street, File Z-25-04, opened at 7:42 p.m.  Peter Baril, applicant, stated this would be a multi-service beauty salon for hair, nails and with 6 tanning booths.  The sinks in the workstations, used in the hair dye process, would drain to an underground holding tank to avoid chemicals from entering the ground. The property is connected to a septic system.  The Site Plan shows improvements to the parking lot.  Mr. Baril stated that the salon would be open 6 days a week from 8:00 a.m. to 6:00 p.m. and possibility part time on Sunday.  A member of the public asked about the minimum age of a person using the tanning booths.  The public hearing closed at 8:04 p.m.

ON A MOTION by Linda Spevacek, seconded by Margaret Chapple, the Commission voted to approve an application for Special Permit for a Residential Landscape Business as outlined in the Layout Plan, identified as Exhibit A and a business description, identified as Exhibit B, located at 188 Salmon Brook Street, File Z-23-04, with the following conditions:

1.      The Eastern White Pine Trees that are identified as a proposed buffer towards the front of the property shall have a minimum height of 6 feet and be spaced no more than 8 feet apart.  It is anticipated that the trees will be staggered rather than planted in a straight line.  The trees must be planted by May 30, 2005.

2.      The owner of the land to which his permit relates shall submit a request for a review of this Special Permit to the Commission during the 2009 calendar year.  At such time, the Commission shall evaluate the operation of the activities allowed by this permit to determine if they are in compliance with the Residential Landscape Business Regulations and the conditions of the permit.  The failure to submit such review on or prior to December 31, 2009 may result in the revocation of the permit.  The Commission may revoke this permit at any time, if the owner of the affected land to which this permit relates is found to be operating in violation of the Residential Landscape Business Regulations and the conditions of the permit, provided that such owner has had an opportunity to respond to the Commission’s concerns.

3.      A maximum of 6 employee parking spaces are permitted.

4.      The normal hours of operation shall be 6:30 a.m. to 6:30 p.m.

5.      The site shall be designed and maintained as outlined on the subject drawing and all vehicle and equipment storage must be as identified thereon.

6.      The Business description, Exhibit B, shall be filed with the Special Permit Form.

7.      The proposed barn is approved as located and as proposed with traditional design, wood frame and siding

All approved.  Charles Kraiza abstained.

The Commission received an application for the alteration or reconstruction of a Scenic Road, known as Lost Acres Road, File Z-26-04 and an application for a modification to an approved Site Plan that proposes a 3,200 square foot, open shed style building for property located along a ROW know as Manitook Road and known as at 516 and 516R Salmon Brook Street, File Z-27-04.

At the October 26, 2004 meeting the Commission will hold public hearings on the following applications:

1.       Public hearing on an application for the alteration or reconstruction of a Scenic Road, known as Lost Acres Road, File Z-26-04.

2.      Public hearing on an Amendment to the Zoning Regulations, Section 8.10 concerning a Bed and Breakfast or Inn Use, File Z-24-04.

3.      Public hearing on a modification to an approved site plan that proposes a 3,200 square foot, open shed style building for property located at 516 and 516R Salmon Brook Street, File Z-27-04.

ON A MOTION by Linda Spevacek, seconded by Margaret Chapple, the Commission voted to approve an application for a Special Permit for Personal Service and Use within an Aquifer Protection Overlay Zone, as outlined in Exhibit A and Exhibit B of the file for property located at 345 Salmon Brook Street, File Z-25-04, with the following conditions:

1.      A holding tank must be installed to contain the wastewater generated from the sinks used in the hair dying process.
2.      The personal services are limited to hair cutting and treatments, fingernail maintenance and treatments and tanning as proposed.  No other personal services will be allowed without prior action of the Commission.
3.      The hours of operation are 8:00 a.m. to 8:00 p.m.
4.      The proposed parking shall be installed prior to the issuance of a Certificate of Occupancy for the use of the property as outlined herein.
5.      All new signage must conform to the requirements of the Zoning Regulations.

The meeting adjourned at 8:26 p.m.
