PLANNING AND ZONING COMMISSION
MINUTES
OCTOBER 26,2004

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer.

The meeting opened at 7:04 p.m.

Public session:  There was no public comment.

ON A MOTION by James Sansone, seconded by Charles Kraiza, the Commission voted to approve the minutes of October 12, 2004.  All approved.  Fred Wilhelm abstained.

Public hearing on an application for the alteration or reconstruction of a Scenic Road, known as Lost Acres Road, File Z-26-04, opened at 7:06 p.m.  Jamie Klase, Superintendent of Public Works, gave an overview of the status of Lost Acres Road.  Mr. Klase stated that there has been only basic maintenance to this road since 1948 when it was last overlayed.  The road is in need of a complete reconstruction.  The reconstruction is primarily to improve the road base and drainage.  The existing base will be ground up and the road will be repaved in the current location.  The curves and grades of the road should not be altered.  The road width varies from 22 to 17 feet.  It is hoped that an average road width of 20 feet can be maintained.  The existing shoulders and side slopes will be maintained, except as is necessary for drainage and erosion.  Trees and other vegetations will only be removed if they are dead, or dying, unsafe, necessary for drainage or safety.  No telephone poles will be relocated or stonewalls affected.  The reconstruction will be done in phases and will probably take a full year.  Various residents spoke during the public hearing.  The comments were not so much for or against the project, but appeared to express a concern that great care and considering be given not to compromise the scenic value of the road.  Other concerns expressed were for speed, safety, and school buses.  It was suggested that the Inland/Wetland and Watercourses Commission and various State Departments be involved.  The DPW was encouraged to mark out any significant trees that were to be removed.  A concern was raised about the large number of the existing Hemlock trees and the problems these trees are currently facing.  A resident suggested that photos be taken before and after the project.  It was requested that Commission members visit the site before work is done.  The public hearing closed at 8:19 p.m.

Public hearing on an Amendment to the Zoning Regulations, Section 8.10 concerning a Bed and Breakfast or Inn Use, File Z-24-04, opened at 8:20 p.m.  The applicant was unable to attend and the public hearing will be continued to November 9, 2004.  A letter has been received from the Capitol Region Council of Government.  The public hearing adjourned at 8:21 p.m.

Public hearing on a Modification to an Approved Site Plan that proposes a 3,200 square foot, open shed style building for property located along a ROW know as Manitook Road and known as 516 and 516R Salmon Brook Street, File Z-27-04, opened at 8:22 p.m.  Kevin Clark, Engineer, informed the Commission that construction of the main building is not possible this year.  Mr. Max, owner, stated because of the delay he would like to construct an 80 x 40 square foot metal, open sided permanent building in the northwest corner of his parcel.  The building would be used to garage his vehicles, particularly during this coming winter and for storage only.  Members of the public asked if this would exceed the minimum coverage requirement and about the access to the building.  The public hearing closed at 8:34 p.m.

The Commission held a discussion with Chris Anderson, Chairman of the Conservation Commission, concerning Ridge Line Development.  Ms. Anderson gave an overview of the concerns and read a letter into the minutes.  The Commission indicated that they would be very pleased if the Conservation Commission took on the project by forming a committee and preparing a regulation to address the concerns.

ON A MOTION by Margaret Chapple, seconded by Charles Kraiza, the Commission voted to approve a Modification to an Approved Site Plan that proposes a 3,2000 square foot, open shed style building for property located along a ROW know as Manitook Road and known as 516 and 516R Salmon Brook Street, File Z-27-04, with the following conditions:

1.      The approval is subject to all previous conditions that were attached to the original approval.
2.      The only approved change to the site plan is for the construction of the building as proposed.
3.      The building may be used for vehicle and similar storage only.
All approved.

The meeting adjourned at 9:01 p.m.
