MINUTES
FEBRUARY 22, 2005
Present: Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer.
The meeting opened at 7:03 p.m.
Public session: There was no public comment.
ON A MOTION by Frederick Wilhelm, seconded by Charles Kraiza, the Commission voted to approve the minutes of February 8, 2005. All approved.
Public hearing on an application for Special Permit that proposes a restaurant, located within an Aquifer Protection Overlay Zone, for property located at 9 Mill Pond Drive, File Z-3-05, opened at 7:04 p.m. Alan Salvadori, owner of the proposed Domino’s Pizza, stated that this is a delivery and take out business. The product is baked and meats are precooked. According to State classification it is considered a bakery. The hours of operation are Sunday – Thursday, 11:00 a.m. to 11:00 p.m. Friday – Saturday, 11:00 a.m. – 12:00 p.m., for a total of 88 hours per week. Two tables and six chairs will be made available to the walk-in customers. Mr. Salvadori also stated they will employ approximately 10 – 20 people. There will be 10 delivery drivers
using personal vehicles and at least four inside people. The sign will be inserted with in the existing building awning in accordance with the regulations. Members of the public inquired about the ages of the delivery drivers and vehicle ownership. Public hearing closed at 7:16 p.m.
Public hearing on an application for a 2-lot FRD subdivision for property located at 100 Lost Acres Road, File Z-4-05, opened at 7:17 p.m. Ed Lally, Engineer and Land Surveyor, representing Sidney Pinney, presented a site plan to the Commission. After briefly reviewing the informal discussion that was held February 8, 2005, he stated that the proposed site for this first phase of a two-phase, 11-lot FRD subdivision consists of 11.89 acres. Lot 1 will be 2.69 acres, Lot 2 will be 2.26 acres and 6.56 acres will remain as open space owned by a Lost Acres Homeowners Association. The existing stone walls located within the area of the subdivision will be preserved. A letter has been received from the Farmington Valley Health District stating the soils can support wells and septic systems.
The Inland/Watercourse Commission has approved the 2 lots. John Jenkins, 62 Lost Acres Road, presented the Commission with a letter of concern and related documents. He read his letter to the Commission. Mr. Jenkins then continued, reiterating his concerns. The primary concern appears to be the possibility of soil contamination. He asks that soil testing be done for arsenic on each of the 2 proposed lots. Mr. Lally discussed the prior soil testing that was done on this property. Fran read a letter into the minutes from John and Carol Day, 96 Lost Acres Road. Other members of the public spoke, primarily expressing their concerns in regards to the possibility that the soils are contaminated. A property owner who lives on Lost Acres Road, across from proposed lot 100, expressed concern for the location of the driveway. The Commission members generally agreed that the applicant should test the soil of the 2 lots for arsenic. The soil samples will be taken from the general
area of the proposed homes. The public hearing adjourned at 8:42 p.m. to be continued March 22, 2005 to allow the applicant time to test the soil.
The Commission considered an application for a one-lot subdivision for property located at 514 Salmon Brook Street, State Line Oil/Propane property, File P-1-05. Brian Guarco discussed the matter with the Commission. The separation of a lot was originally considered and approved as part of the State Line Propane application, File Z-21-04. However, it has come to light that a parcel was previously split from this property around 1960 and therefore the proposed lot creates a subdivision. The proposed lot is in compliance with the subdivision requirements and a letter from the FVHD has been received. The proposed lot was found to be reduced in size from the parcel that was originally approved for the State Line Propane application. The Commission members needed more time to consider the
matter and agreed to keep the discussion of the application open until the next meeting.
Brian Guarco asked the Commission for a clarification of condition #4 in the Commission’s approval of the application of State Line Propane, File Z-21-05. Condition #4 states that “The proposed fence, which is to be constructed along the southern property line, shall be moved off the property line, 8 feet into the subject property. American Arborvitae, smaragd or similar variety, at least 6 feet in height, shall be planted between the fence line and the property line, spaced no greater than 10 feet on center.” Mr. Guarco sought a determination of the southerly property line as there are 2 areas that can be defined as the southern property line, intersected by a westerly property line. The Commission agreed that the fence was to be relocated and the plantings installed, along the
first portion of the southerly property line only. That is, the area that extends from Salmon Brook Street, 250 back to where the property line shifts to the south.
Steve Boucino, owner Cambridge House Brew Pub, 357 Salmon Brook Street, appeared before the Commission to discuss changes to the approved site plan, for application known as Z-3-04. Mr. Boucino stated he had met with the Department of Transportation concerning the island along Salmon Brook Street. The DOT will allow the island to remain as installed but no lights or signs may be placed on it. The boulders will have to be removed from the island and only low-level plants or shrubs may be planted. The Commission members viewed plans that proposed the use of lattice to cover over the unsightly ductwork. The proposal was unacceptable and the Commission suggested that it would be best to simply paint it.
ON A MOTION by Put Brown, seconded by Fred Wilhelm, the Commission voted to approve the proposed modifications to the site plan for the Cambridge House Brew Pub, 357 Salmon Brook Street, File Z-3-04, as follows:
The required site improvements shall be constructed and installed as shown on the original approved plan, except as modified by the Commission on 2-22-05, map exhibit A, and as outlined below. Due to Winter conditions, the Cambridge House Brew Pub and restaurant may open without the completion of all required site improvements, provided a cash bond in the amount of $15,000 is placed on file with the Commission prior to the issuance of a Certificate of Occupancy. All site improvements must be completed by July 15th 2005.
1. The front island may be reduced from the approved 21 feet to 13 feet and filled with stone rather than grass.
2. The front landscaped island, located in front of the glass portion of the building may be eliminated in front of the AC unit on the concrete pad. This island shall be extended by 4 feet to the east and planted with a variety of mountain laurel, rhododendron, azalea, burning bush and similar plant materials as opposed to the trees that were originally proposed and approved.
3. The grass island to the southwest area of the building may be eliminated. A two-foot paved island that extends to the west of this area shall be installed. The circular island that was installed around the existing wellhead may remain, provided a decorative wood wishing well structure is placed within the island.
4. The site shall contain all plantings as originally proposed, with the locations modified in accordance with the approved site changes. The Director of Community Development shall approve the locations of the plantings.
5. The parking arrangement may be modified as outlined on exhibit A.
6. The deck and entrance may be modified as outlined on exhibit A.
7. The roof drainpipe that is below the pavement, with the discharge area located to the southwest portion of the parking lot is approved.
8. Except as noted herein all lawn areas shown on the original plan shall be established as lawn areas.
9. The electrical transformers may remain within the area formerly identified as employee parking.
10. The AC unit may remain on the concrete pad.
11. All sidewalk modifications as currently completed on site are approved.
12. Site improvements that need to be completed include, but are not limited to:
· The establishment of all required lawn areas.
· The dumpster pad and fence.
· All installation of all plant materials.
· Landscape and parking islands
· The final striping of the parking lot.
· The placement of the parking lot wheel stops.
The vote was 6 to 1. Paula Johnson, Put Brown, Margaret Chapple, Charles Kraiza, Linda Spevacek and Fred Wilhelm voted to approve the motion and James Sansone voted against the motion.
There was no action at this time concerning the request to establish Tinker Trail as a Town road. The Town Engineer feels that he cannot make a proper determination on the acceptability of the road during the winter season.
A public hearing on an amendment to Section 3.1 of the Subdivision Regulations concerning open space and fees in lieu of open space, File P-2-05 has been scheduled for March 8, 2005.
A public hearing for an application for a Special Permit for a Rear Lot Subdivision that proposes one additional lot for property located at 72 Bushy Hill Road, File Z-2-05, has been scheduled for March 8, 2005.
The Commission received an application for a Site Plan and Special Permit for use within an Aquifer Protection Overlay Zone, for property located at 15-17 Mill Pond Drive, File Z-6-05, and set it for public hearing.
Margaret Chapple left the meeting at 9:45 p.m.
ON A MOTION by James Sansone, seconded by Fred Wilhelm, the Commission voted to approve an application for Special Permit that proposes a restaurant, located within an Aquifer Protection Overlay Zone, for property located at 9 Mill Pond Drive, File Z-3-05. All approved.
