PLANNING AND ZONING COMMISSION
MINUTES
MAY 10, 2005
Present: Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Director of Community Development.
The meeting opened at 7:05 p.m.
Public session: There was no public comment.
ON A MOTION by Margaret Chapple, seconded by Fred Wilhelm, the Commission voted to approve the minutes of April 26, 2005. All approved.
Public hearing on an amendment to Section 4.16 Private Streets opened at 7:06 p.m. Fran reviewed with the Commission the present regulations and discussed the reasons for the proposed changes. The amendment will add clarity to the process of constructing, dedicating and completing private streets.
There were no public comments. The public hearing closed at 7:15 pm.
Public hearing on a Site Plan Modification for Rome’s Sporting located at 335 Salmon Brook Street, File Z-10-05, opened at 7:16 p.m. Robert Rome, owner, stated that since he bought the property he has been trying to improve the business and the aesthetics of the property. Mr. Rome indicated that he primarily sells items for team sports, fishing and hunting. He proposes to change the main entrance of the building from the side to the front. The change includes the construction of a porch that will extend along the entire front of the building and along both sides. Mr. Rome feels that besides improving the access to the business, the proposed changes will be very attractive, demonstrate the change of ownership and help to improve business. Mr. Rome briefly discussed the work that
was done to the earth bank located to the south of the building. The removal of trees and re-sloping of the bank was to improve visibility, add light to the site and reduce icing in the parking area. There was no public comment. The public hearing closed at 7:25 p.m.
The Commission held an informal discussion with William Pease concerning a possible rear lot off of Old Messenger Road. Mr. Pease informed the Commission that as the result of a Superior Court Judgment concerning Old Messenger Road, he has the right to enter his property from Old Messenger Road. The judgment includes the right to construct a new home within this area, provided that he receives an approval from the Commission for a rear lot. Mr. Pease presented a map of the proposed rear lot, which met the minimum dimensional requirements for a rear lot.
The public hearing for a Zone Change for property at 379 North Granby Road, File Z-11-05 is scheduled for May 24, 2005.
The public hearing for an application for a 2-lot FRD Subdivision for property located at 100 Lost Acres Road, File Z-12-05 was not scheduled.
The continuation on an application for a Special Permit for FRD Subdivision, final phase of development for Cider Mill Heights, File Z-05-05 will be May 24, 2005.
The Commission received an application for a rear lot Subdivision for property located at 71 and 124 Quarry Road. The public hearing is tentatively scheduled for June 10, 2004.
The Commission received an application for the Retail sale of antiques within an R2A zone for property located at 70 Silkey Road.
Fran reviewed with the Commission the proposed regulation changes for Rear Lots, Contiguous Developable Areas and Open Space requirements for FRD Developments.
All of the discussed amendments will be referred to the Capital Region Council of Governments, as necessary. The Commission would like to hold a public hearing on the amendments in the near future.
Fran discussed with the Commission an early draft of a Traditional Neighborhood Zone for the North Granby Center area. The Commission appeared to support the concept and Fran will continue working on it.
The Commission discussed an amendment to Section 4.16 Private Streets. Minor changes to the wording was suggested and discussed.
ON A MOTION by James Sansone, seconded by Put Brown, the Commission voted to approve an amendment to Section 4.16 Private Streets with minor changes. All approved as the Commission found that the amendment would clarify the process of developing private roads. Linda Spevacek abstained.
The final copy of the amendment is attached and made a part of these minutes.
ON A MOTION by Put Brown, seconded by Fred Wilhelm, the Commission voted to approve a Site Plan Modification for Rome’s Sporting Located at 335 Salmon Brook Street, File Z-10-05, as presented and with the following condition:
There shall be no storage or display of merchandise on the porch without the prior approval of the Commission.
All approved, as the modification was found to be in compliance with the regulations.
The Commission members expressed their disappointment with the aesthetics of the Old Oak Tavern. They noted sign violations and the placement on tree length logs and large concrete forms on the property. They asked that the Zoning Enforcement Officer take action on the sign violations and that Fran Armentano investigate the probable site plan violations relative to the logs and concrete blocks.
