PLANNING AND ZONING COMMISSION
MAY 24, 2005
MINUTES

Present:        Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek, Frederick Wilhelm, Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer.

The meeting opened at 7:05 p.m.

Public session:  There was no public comment.

ON A MOTION by Margaret Chapple, seconded by Fred Wilhelm, the Commission voted to approve the minutes of May 10, 2005. All approved.

The application for a 2 lot FRD Subdivision for property located at 100 Lost Acres Road has been withdrawn.  The original applicant has indicated that this application may be re-filed when soil testing has been completed.

Continuation of a public hearing on an application for a Special Permit for FRD Subdivision, final phase of development for Cider Mill Heights, File Z-5-05, resumed at 7:07 p.m.  Jim Sansone abstained and removed himself from any participation regarding this matter and left the Commission table.  Ed Lally, P.E., gave an overview of the subdivision application.  Additional soil testing has been done on various lots in response to the negative report that was received from the Farmington Valley Health District, dated April 25, 2005.  Mr. Lally addressed a variety of concerns through a Revised Declaration of Restrictions and Protective Covenants.  He discussed the 24 numbered paragraphs.  Mr. Lally also discussed tree height, as average canopy height, and related it to the anticipated new building height and visibility.  He discussed an Inspection Schedule, particularly as it relates to erosion control and discussed anticipated material hauling and building and construction equipment access and egress.  Mr. Lally indicated that he has been contacting and working with the existing homeowners to plant street trees throughout the existing subdivision.  John Bahre, John W. Bahre Drilling & Blasting, discussed the blasting process, as many of the lots will require blasting in order to construct the proposed new homes.  He discussed the types of ledge that is found in this area and the removal process.  He stated that blasting is an activity that is regulated and inspected by the local fire marshal and the state.  Chris Anderson, Conservation Commission, asked questions about the Homeowners Association rules. She asked about the process of changing the rules and asked about penalties and the standards and enforcement of the declaration.  Bob Patrick, an area builder, said that blasting doesn’t affect wells and most of the rock that is left from the blasting can be crushed and used on site.  He stated that he is very selective in the removal of trees on his lots and expressed concern for Lot 603.  The public hearing will be extended for 30 days to allow time to receive a revised FVHD letter and time for the Commission and staff to review the various material that were recently submitted.  The public hearing adjourned at 9:01 p.m. to be continued June 28, 2005.

Public hearing on an application for a zone change for property at 379 North Granby Road, File Z-11-05, opened at 9:02 p.m.  Ed Lally, P.E., representing Tom Fredo, presented the application. The history of this parcel, particularly a previously approved zone change and site development plan were discussed.  The owner’s past efforts to market the property for commercial use were discussed.  The property owner, Tom Fredo wants to build a single-family home on the property.  The Commission discussed the creation of a more traditional zone for the general area, which would allow residential use with a mix of limited commercial activity.  Mr. Fredo indicated that he would support such a change.  An area homeowner inquired about the storage of construction equipment on this site and asked if the property would be split into 2 lots.  The public hearing closed at 9:13 p.m.

The Commission continued the discussion of various Zoning and Subdivision Amendments.  Fran reviewed the changes and stated that these materials have been sent to the Capital Region Council of Governments for review.  The public hearing is scheduled for June 28, 2005.

Public hearing for an application for a Rear Lot Subdivision for property located at 71 Quarry Road and 124 Notch Road, File Z-13-05, is scheduled for June 14, 2005.

Public hearing for an application for the Retail Sale of Antiques within an R2A Zone for property located at 74R Silkey Road, File Z-14-05, is scheduled for June 14, 2005.

The Commission received applications for:

·       A Rear Lot off of Old Messenger Road, Pease property, File Z-15-05.
·       An application for a 2-Lot Subdivision on Messenger Road, Messenger Trust, File P-4-05.
·       An application for Renewal of an Excavation Permit for Tilcon, Inc., 536 Salmon Brook Street, File Z-16-05.

The Commission briefly discussed the status of the property located at 376 North Granby Road.

ON A MOTION by James Sansone, seconded by Put Brown, the Commission voted to approve an application for a zone change for property located at 379 North Granby Road, File Z-11-05, as the Commission found the change to be consistent with the Regulations and the Plan of Conservation and Development.  All approved.

The meeting adjourned at 9:25 p.m.
