PLANNING AND ZONING COMMISSION
MAY 23, 2006
MINUTES

Present:        Paula Johnson, Chairwoman, Jonathan Boardman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, and Linda Spevacek.  Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer were also present.

The meeting opened at 7:01 p.m.

Public session:  There was no public comment.

ON A MOTION by Linda Spevacek, seconded by Margaret Chapple, the Commission voted to approve the minutes of May 9, 2006.  All approved.

The Commission held a discussion of a possible amendment to the regulations concerning the definition of a cul-de-sac.  Fran reviewed with the Commission an Enfield Superior Court case, Pappas v. Enfield PZC.  In this case the Superior Court of Connecticut discussed the definition of a cul-de-sac and the Enfield Commission’s interpretation.  The situation is similar to Granby’s definition of a cul-de-sac and the actual interpretation.  However, Granby’s regulations do not differentiate between a dead-end road and a cul-de-sac.  The Commission members and staff agreed that the regulations could be amended to more clearly define a cul-de-sac, dead-end road and through street.  Town staff will begin working on these amendments.

A continuation of a public hearing on an application seeking a Site Plan and Special Permit for use within an Aquifer Protection Overlay Zone to convert a residence to a commercial retail use for property located at 83 Salmon Brook Street, File Z-3-06, resumed at 7:11 p.m.  James Burns, owner, stated that Henry Cotton and Associates, surveyor, has not prepared the changes to the plan that were discussed with the Commission at the last meeting.  Changes have also been recommended by Town staff.  Mr. Burns informed the Commission that the motor home has been removed from the property and that some of the debris has been cleaned up.  Bud Murtha, Kelly Lane, Chairman of the Granby Development Commission, commented that this property is the primary entrance into the T1 zone.  Mr. Murtha encouraged the Commission to emphasize the quality of any proposed development on this site.  This site will be the gateway to the future development of the rear property and its appearance can significantly impact the future development of the area.  He further commented on the overall appearance of the site and the width of the right of way.  The Commission advised Mr. Burns to develop the site in an attractive manner and to recognize its potential in shaping future development.  Mr. Burns consented to extending the time frame for completing the public hearing for up to 35 days.  The public hearing adjourned at 7:17 p.m.

Charles Kraiza entered at 7:12 p.m.

The Commission held a discussion of possible modifications to the Zoning and Subdivision Regulations as necessary to implement the State requirements for a Storm Water Management Plan.   Ed Sweeney reviewed the requirements by the State and Federal Government that will likely result in modifications to the Zoning and Subdivision Regulations.  A new Town Ordinance which addresses this matter will also be prepared.  Ed and Fran will continue working on these matters.
Charles Kraiza left the meeting at 7:27 p.m.

Fran reviewed with the Commission recent actions by the State Senate and House of Representatives during the 2006 General Assembly relative to local planning, zoning, development and preservation.

The Commission received no new applications.

Public hearing on the Laurel Woods 30-lot FRD Subdivision application for property located on Edgerton Road, File Z-7-06, is tentatively set for June 27, 2006.  

Staff Reports and Correspondence:

Fran reported that Powder Mill Lane has been paved and progress continues to be made.  He commented that a security agreement remains in place.  Fran then provided the Commission with a status report on Cider Mill Heights Section IV.

The Pheasant Run development was discussed and the town staff reported that the trees have been cut and the private road is under construction.

The Commission members reported the extra signs have been removed at Cumberland Farms.  Fran noted that Henry Miga will continue to monitor Food Bag and that the CVS sign was also removed.  The Commission and staff briefly discussed the parking lot barriers at the Old Oak Tavern.

Fran stated that he and Put Brown had met with the Hartford Foundation for Public Giving to discuss their new process of considering a town’s affordable housing status, when reviewing grant applications for the purchase of open space. Put Brown elaborated on the meeting and the potential outcome of the discussion.

The meeting adjourned at 8:06 p.m.
