MINUTES


Present:        Paula Johnson, Chairwoman, Jonathan Boardman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza and James Sansone.  Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer, were also present.

The meeting opened at 7:05 p.m.

Public session:  There was no public comment.

ON A MOTION by Margaret Chapple, seconded by Put Brown, the Commission voted to approve the minutes of May 23, 2006.  All approved.  Charles Kraiza and James Sansone abstained.

The continuation of a public hearing on an application seeking a Site Plan and Special Permit for use within and Aquifer Protection Overlay Zone to convert a residence to a commercial retail use for property located at 83 Salmon Brook Street, File Z-3-06, resumed at 7:07 p.m.  Mr. Burns presented a site development plan to the Commission.  The plan is mostly limited to parking and access as the application proposes to convert an existing residential structure to retail use.  The site is identified within the T1 zone as the primary location to serve as the access to the rear land within this zone.  This access was further discussed.  Fran stated that he and Ed would further review the plans with Mr. Burns.  Chairwoman Johnson commented that the appearance of the property has improved and noted that a dumpster has been brought to the site.  She inquired about the status of the fence.  There was no public comment.  Mr. Burns had previously consented to a 30 day extension period for the public hearing.  As additional information is needed, the Commission agreed to keep the hearing open to the June 27, 2006 meeting.  The public hearing adjourned at 7:14 p.m.

Jonathan Boardman entered at 7:11 p.m.

At 7:15 p.m., the Commission opened a public hearing to consider an application to amend the Granby Subdivision Regulations as follows:

a.      Eliminate the definition of – dead-end Street (Permanent).
b.      Add new definition – dead-end street.
c.      Add new definition – cul-de-sac.
d.      Add new definition – through street.
e.      Amend Section 4.4 – Maximum/Minimum Length of a cul-de-sac to dead- end.
f.      Amend Section 4.5 by changing cul-de-sac to dead –end.

Fran Armentano made a presentation on this matter.  The initial review of the cul-de-sac language came about through a decision by the Enfield Superior Court in the case of Pappas v. Enfield PZC. Fran discussed this matter with the Commission and it was agreed that the Commission should reconsider the definition of a cul-de-sac.  The Subdivision Regulations currently use cul-de-sac and dead-end road interchangeably. Section 4.4 provides guidelines for dead-end roads and a review of the specific wording found it to be some what cumbersome and unclear. The proposed changes make the requirements more understandable.  The changes do not modify the basic requirements, or how they have been previously interpreted.  To demonstrate the various ways that dead-end roads can be defined, Fran Armentano presented and explained a number of different sketches. There was no public comment.  The public hearing closed at 7:32 p.m.

The Commission received no new applications at this time.  

Public hearing on the Laurel Woods 30-lot FRD Subdivision application for property located on Edgerton Road, File Z-7-06 is scheduled for June 27, 2006.

Staff Reports and Correspondence:

The Commission asked about the flags at CVS, which are a violation of the Regulations. Fran reported that he previously mentioned this to Henry Miga. Fran reported on an ongoing carwash at CVS.  The activity ceased after it was brought to the attention of the store manager.

Ed Sweeney reviewed the status of the Broad Hill Road bridge repair and the progress of the Route 20 bridge construction.

ON A MOTION by James Sansone, seconded by Charles Kraiza, the Commission voted to approve an application to amend the Granby Subdivision Regulations as follows:

a.      Eliminate the definition of – dead-end Street (Permanent).
b.      Add new definition – dead-end street.
c.      Add new definition – cul-de-sac.
d.      Add new definition – through street
e.      Amend Section 4.4 – Maximum/Minimum Length of a cul-de-sac/dead-end road.
f.      Amend Section 4.5 by changing cul-de-sac to dead end.

All approved as the Commission found that the changes would clarify the requirements.
The amendment is attached and made a part of these minutes.



The meeting adjourned at 7:51 p.m.
