PLANNING AND ZONING COMMISSION
MINUTES
OCTOBER 10, 2006
Present: Paula Johnson, Chairwoman, Jonathan Boardman, Charles Kraiza, James Sansone, Linda Spevacek. Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer were also present.
The meeting opened at 7:01 p.m.
Public session: There was no public comment.
ON A MOTION by James Sansone, seconded by Jonathan Boardman, the Commission voted to approve the minutes of September 26, 2006. All approved.
Public hearing on an application for a one-lot re-subdivision of property located at 514 Salmon Brook Street, State Line Oil, File P-2-06, resumed at 7:03 p.m. This hearing was left open from the previous meeting primarily for the receipt of a letter from the Farmington Valley Health District. Fran Armentano informed the Commission that he has not yet received the Farmington Valley Health District letter, but that he expected to receive it this week. The public hearing will be continued to October 24, 2006 pending the receipt of this letter.

The Commission held a discussion concerning an application for a modification of a site plan to add an additional building of 4,000 square feet for property located at 504 Salmon Brook Street, State Line Propane, File Z-12-06.
ON A MOTION by Jonathan Boardman, seconded by Linda Spevacek, the Commission voted to approve an application for a modification of a site plan to add an additional building of 4,000 square feet for property located at 504 Salmon Brook Street, State Line Propane, File Z-12-06, with the following conditions:
The application is as outlined on map sheets 1-3, prepared for State Line Propane, by Alford Associates, Inc, dated August 3, 2006 and revised to 9-18-06, and a Garage Design prepared by Blue Moon Design dated 9-15-06, sheets A1 and A2.
Conditions:
1. The building shall have no additional windows, doors or other penetrations except as outlined on the Garage Design.
2. The building shall be constructed as specifically outlined on the Garage Design Plan, noted above, except that the number of overhead doors may be reduced and the building siding shall be an earth tone brown, split faced block.
3. The building roofing materials shall be as specifically outlined on the Garage Design Plan noted above.
4. Exterior lighting may be mounted on the front of the building, provided that the light is directed towards the west.
5. The Building may not have floor drains.
6. The building use is restricted to low use warehousing space. Access to the storage building shall be less than twice daily per average month. The site plan is designed to comply with only a warehousing parking standard of .5 parking spaces per 1,000 square feet.
7. Prior to the start of construction, the 40-foot buffer must be marked out on the site.
8. Trees and shrubs shall be planted between the proposed building and the propane storage tanks, as directed by the Director of Community Development.
Fran Armentano supplied the Commission with various information and fact sheets from the Department of Environmental Protection concerning Outdoor Wood Burning Furnaces. The State placed restrictions on the placement of the furnaces effective October 1, 2005. The consensus of the Commission was to amend the Zoning Regulations to prohibit the installation of Outdoor Wood Burning Furnaces. Fran will refer the matter to the Capitol Region Council of Governments and set public hearing. He will also notify the Selectmen of the Commission’s anticipated action.
The public hearing for amendments to the Zoning and Subdivision Regulations concerning Erosion and Sediment Control is scheduled for October 24, 2006.
The public hearing on an application for a renewal of a Special Permit for the sale of antiques for property located 74R Silkey Road, File Z-19-05, is scheduled for October 24, 2006.
Staff Reports and Correspondence:
Fran reported on the status of the Cider Mill Heights Subdivision, Phase III (White Birch Turn), Mr. Patrick, the road ownership, completion and maintenance.
Fran informed the Commission that the owner of 17 Salmon Brook Street has been issued a cease and desist as the Town has received several complaints for continuous tag sales.
