PLANNING AND ZONING COMMISSION
MINUTES
NOVEMBER 14, 2006


Present:        Paula Johnson, Chairwoman, Jonathan Boardman, Jr., Margaret Chapple, Charles Kraiza, James Sansone, Linda Spevacek. Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer were also present.

The meeting opened at 7:04 p.m.

Public comment:  There was no public comment.

ON A MOTION by James Sansone, seconded by Margaret Chapple, the Commission voted to approve the minutes of October 24, 2006 with the following correction:  Page 3, paragraph 7, sentence 1 should read Jonathan Boardman.  All approved.

Public hearing on an application for commercial subdivision for property located at 33 and 35 Hartford Avenue, File Z-16-06, opened at 7:06 p.m.   Ed Voskowsky, representing Hartford Avenue Associates, stated that they are seeking to split property located at 33 Hartford Avenue into 2 parcels.  There are two separate office buildings located on this property.  The proposed split would place the buildings on separate properties.  The subdivision of the properties is to accommodate the sale of one of the buildings to a separate owner.  The subdivision plan establishes common areas that are shared by the 2 properties.  These include access and egress, parking and drainage.  Staff asked that the water lines be identified on the plan.  Mr. Voskowsky requested that the fee for the open space be waived since this property had originally been two separate parcels.   A member of the public inquired about the size of the lot.  Public hearing closed at 7:13 p.m.

The Commission held a discussion concerning an application for a renewal of a Special Permit for the sale of antiques for property located at 74R Silkey Road, File Z-14-05.

ON A MOTION by James Sansone, seconded by Linda Spevacek, the Commission voted to approve an application for a renewal of a Special Permit for the sale of antiques for property located at 74R Silkey Road, File Z-14-05, with the following conditions:

1.      No more than 600 square feet of barn space may be used for the sale of antiques.  The antique sales shall be re-located to the lower barn, south of the house, as originally approved, no later than August 1, 2007.  The Building Inspector will make a determination as to whether or not the barn can be used as proposed.  The antique sales shall not commence until such time that the Building Inspector has approved the location of the sales.

2.      The antique sales are permitted Monday through Friday by appointment only.  The hours that the antique shop may be open to the general public are limited to Saturdays from 9:00 am to 4:00 pm and Sundays from 11:00 am to 4:00 pm.  Additionally, the above Saturday hours may be applied to Fridays, no more than 4 times per year.  

3.      The sale of antiques shall cease on January 1, 2009, unless the Commission votes to renew the Special Permit.  The applicant may seek to renew the Special Permit by filing a request to renew the application.  The request to renew may be submitted to the Commission anytime after September 1, 2008. Upon receipt of the request, the Commission shall hold a public hearing to solicit comments on the antique sale business to determine the impact on the neighborhood.  Should the applicant fail to file a request to renew the Special Permit by April 15, 2009; the Special Permit shall be permanently terminated.  Following the public hearing, the Commission may vote to revoke the Special Permit, to permit the sale of antiques or to permit the sale with conditions.

4.      Only one sign, which advertises the sale of antiques, may be permitted.  The sign may have a maximum size of 6 square feet and may not be illuminated.  The placement of signs that advertise the antique sales off of the immediate premises is prohibited.  The placement of such signs shall result in the immediate revocation of the Special Permit.

5.      The Special Permit will automatically terminate if the ownership of the property changes from the ownership of record outlined within the Granby Land Records on July 26, 2005.

All approved.

Fran Armentano stated that the Granby Board of Selectmen held a public hearing, November 6, 2006 and voted to acquire Cider Mill Heights, Section III, as recommended by the Commission at its October 24, 2006 meeting.

Fran Armentano updated the Commission on the Case Street Study.  Chairman Johnson sent letters of thanks to the Committee members.  The report has been referred to the Capitol Council Region of Governments and the Granby Board of Selectmen.   A public hearing is tentatively scheduled for January 9, 2007, when the Commission will consider the adoption of the report as an amendment to the Plan of Conservation and Development.  Chairwoman Johnson read a letter from Joann Malave, 22 Edgerton Road, into the minutes.

The public hearing on a proposed amendment to the Zoning Regulations to prohibit the installation of outside wood burning furnaces, File Z-15-06, is scheduled for November 28, 2006.

Staff Reports and Correspondence:

Fran noted that there is a reference to Granby’s Plan of Conservation and Development in a report on Biodiversity Conservation in Connecticut.

The Commission discussed the Unified Sign Plan at 10 Hartford Avenue. Fran reviewed the letter he sent to Robert Swartz, owner, concerning the Lox, Stocks and Bagels sign.  The Commission was clear that all new signs should follow the unified sign plan.

The Commission discussed an application for commercial subdivision for property located at 33 and 35 Hartford Avenue, File Z-16-06.  The Commission appeared to find that the application was in compliance with the requirements for subdivision.  In regards to the request for a waiver, the Regulations do not state that the Commission can or cannot waive the Useable Open Space.  The members felt that it would be reasonable to waive the open space as this is a fully developed commercial property.  However, the Commission was unwilling to waive the open space as the right to do so was not clearly identified within the regulations.  The Commission directed Fran Armentano to prepare an amendment to the regulations which addresses the circumstances when the Commission may consider a waiver of the open space requirements.  No action was taken on the subdivision application.
