PLANNING AND ZONING COMMISSION
MINUTES
April 24, 2007
Present: Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, and Linda Spevacek. Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer.
The meeting opened at 7:02 p.m.
Public session: There was no public comment.
ON A MOTION by Linda Spevacek, seconded by Margaret Chapple, the Commission voted to approve the minutes of April 10, 2007 with the following correction: Page 1, paragraph 7, sentence 1 should read; John Oates, Deputy Fire Marshal, stated he is a life long resident of Granby, a former member of the Lost Acres Fire Department and works with other communities on fire safety issues. All approved. Put Brown abstained.
Public hearing on an application for a Special Permit to construct a barn/garage in excess of 1,000 square feet for property located at 12 Brookside Drive, File Z-4-07, opened at 7:04 p.m. Bill Russell, owner, stated he would like to construct a barn that will be 1,152 square feet. The barn would be used for a studio for woodcarving, workshop and storage of boat and lawn maintenance equipment. The proposed barn meets all building setback regulations. Mr. Russell indicated he contacted the adjacent neighbors and they had no objections. He presented photos of the barn which he built at his former location and stated that the proposed barn is similar to that barn except for the pitch of the roof. He also stated there is a hemlock hedge between the barn and the immediate neighbor. The
style fits into the character of the neighborhood. The barn would have wood siding, electricity, a wood stove and an outside water faucet. There was no public comment.
The Commission held a discussion concerning a request for a subdivision modification per Section 5.2.8 for the Silver Brook Estates Subdivision with Ed Lally, Professional Engineer. Mr. Lally is asking the Commission to modify the area and lot width of lot #24 of the Silver Brook Estates Section 2 Subdivision. He seeks to have the lot reduced by 23 feet at the street line, tapering down to meet the original lot line approximately 370 feet back. The lot area is proposed to change from 2.005 acres to 1.899 acres. There is no measurable change in the development potential of the lot. The request will slightly impact the shape of the lot. Mr. Lally seeks the modification due to a series of errors which were made in the map references and descriptions relative to the southern lot line of lot 24
which it shares with lot #23. The Commission felt that while the request was unusual, the modification provides a reasonable solution to an unfortunate situation without impacting the development of the lot. No additional development or construction will result from the requested modification beyond that which was originally anticipated when the subdivision was first reviewed. Mr. Lally indicated that the buyers of lot #24 simply want to be able to build their house on this parcel as originally anticipated in the Silver Brook Estates Subdivision.
The Commission continued a discussion of a draft copy of zoning amendments and a zone change based on the Plan of Conservation and Development, The Case Street Area, A Formula for the Preservation and Development of a Unique Section of the Town of Granby. Put Brown abstained from the discussion. Fran indicated he sent a copy of the draft to Barkhamsted, Canton and the Capital Region Council of Governments for review. He went on to reference the excellent presentation by John Oates, relative to the requirement for sprinkler systems. Chairwoman Johnson noted that the proposed increase in lot size and the need for sprinkler systems are likely to be major areas of concern. The public hearing is anticipated for the May 22, 2007 meeting.
The Commission held a discussion of areas where drive through windows for restaurants may be permitted. Fran Armentano provided a map that showed areas that are greater than 1000 feet from a residential zone. The Commission briefly discussed concerns for noise and location of drive trough windows from residential properties.
The Commission received an application for a 5-lot subdivision for property located at 120 Silver Street, property of Design Builders, formerly property of Rose O’Meara, File P-1-07. The public hearing is scheduled for May 9, 2007.
Staff Reports and Correspondence:
Fran reported that the 10,000 acre forum that was sponsored and undertaken by the Conservation Commission on Saturday, April 21, 2007, went very well. Put Brown spoke regarding Open Space, Sally King spoke on Farm land, Charles Katan spoke on Wetlands and Bill Bentley on Forest land. All speakers did an excellent job. Put Brown stated that Fran’s presentation on, “Where we are from a regional perspective and why all this matters” was very informative.
There was no discussion of items of interest or concerns.
ON A MOTION by Margaret Chapple, seconded by Linda Spevacek, the Commission voted to approve an application for a Special Permit to construct a barn/garage in excess of 1,000 square feet for property located at 12 Brookside Drive, File Z-4-07, as the application was found to be in compliance with the Zoning Regulations. All approved.
ON A MOTION by Put Brown, seconded by Margaret Chapple, the Commission voted to approve a subdivision modification per Section 5.2.8 for the Silver Brook Lane Subdivision, Section 2 for lot 24 as outlined on the proposed maps for Silver Brook Estates, Section 2 dated April 12, 1998 and revised to 4/20/07, provided that a note is included on the final mylar which documents the unique situation as outlined within these minutes. All approved.
