PLANNING AND ZONING COMMISSION
MINUTES
OCTOBER 27, 2009

Present:  Margaret Chapple, Acting Chairwoman, Daniel P. Brown, Jr., Charles Kraiza,  Paul Lambert, James Sansone and Linda Spevacek.  Francis Armentano, Director of Community Development.

The meeting opened at 7:02 p.m.

Public session:  There was no public comment.

Minutes:  ON A MOTION by James Sansone, seconded by Linda Spevacek, the Commission voted to approve the minutes of October 13, 2009 with the following correction:  Page 1, Paragraph 5, last line the date should be October 27, 2009.  All approved.  Put Brown abstained.

The continuation of a public hearing on an application for a 10-lot FRD special permit and subdivision for property located at 100 Lost Acres Road, file Z-7-09, resumed at 7:04 p.m.  John Horr, Jr., Fire Chief Lost Acres Fire Department stated that some of his initial concerns regarding the road length, width of pavement and the hammerhead turnaround have been addressed and have alleviated many of his initial concerns. Chief Horr discussed the limited availability of water within this and other areas of Town for fire fighting purposes.  He and Mr. Dumais have discussed the issue and they are working to address the concern related to the proposed 10 additional homes.  Chief Horr noted that he and the LAFD have begun work on a Town wide investigation of the issue. The Commission members discussed the matter with Mr. Horr then thanked him very much for attending.  Dan Dumais commented on his view of the regulations.  Attorney Richard Case was also in attendance.  The public hearing closed at 7:23 p.m.

The public hearing on an application seeking a renewal of an Earth Excavation Permit for property located at 359 North Granby Road, Hayes property, File Z-9-09, opened at 7:24 p.m.  Stephen Hayes presented the application.  He submitted photos of the site.  He stated that they have made significant progress in the excavation and restoration of the property as originally approved by the Commission. These changes have improved the property for agricultural use, but due to the wet year and the decline in the economy they have been unable to complete the project within the time frame of the permit.  There is no proposed increase in the number of cubic yards being removed.  The project is going according to the original approval but it is taking longer than anticipated.  Mr. Oates, 330 North Granby Road, stated that he is pleased that the issue of loading and unloading equipment has been addressed since the last public hearing.  He asked that no trucks be allowed to leave the site between 3:00 p.m. to 5:00 p.m.  Mr. Hayes indicated he would speak to his contractor about the concerns of Mr. Oates, though he was concerned about the impact that such a restriction might have on the operation.  The public hearing closed at 7:44 p.m.

The public hearing on an application for Earth Excavation for property located at 125 North Granby Road, file Z-2-09, opened at 7:45 p.m.  Ben Butch presented a grading plan and stated that presently he has no useable backyard due to the steep slopes.  He wants to re-grade his property to create a more usable and attractive property.  The Commission members questioned the final grades of the property.  Dan Girard, Simscroft-Echo Farms, also discussed the re-grading plans and the process to remove the topsoil and reseed the property.  Mr. Girard assured the Commission that the slopes would be reseeded and stabilized.  He estimated the process to take 2 – 4 weeks.  Letters were received from the abutters in favor of the project. The Town Engineer could periodically inspect the property during the removal process.  Local neighbors reviewed the site plans.  The public hearing closed at 8:05 p.m.

Staff Reports and Correspondence:
Fran reported he anticipates receiving an application for a property within the new center zone soon.
The Commission will be receiving an application for a 10-lot subdivision for property on Day Street in the next 2 months.  There has been continued interest in the transition zone, though no applications for development are anticipated in the near future.  Fran had nothing new to report on the Mill Pond Drive land.  He reported that the Canton Road sewer construction is reasonably progressing.
