PLANNING AND ZONING COMMISSION
MINUTES
DECEMBER 9, 2008
Present: Paula Johnson, Chairwoman, Daniel P. Brown, Jr., Margaret Chapple, Charles Kraiza, Paul Lambert, Linda Spevacek, Francis Armentano, Director of Community Development and Edward Sweeney, Town Engineer.
The meeting opened at 7:03 p.m.
Public session: There was no public session.
ON A MOTION by Linda Spevacek, seconded by Charles Kraiza, the Commission voted to approve the minutes of November 25, 2008 with the following correction: Page 3, paragraph 1, Paula Johnson abstained. All approved.
The Commission held a discussion of an application seeking a special permit for the retail sale of antiques, for property located at 114 West Granby Road, File Z-15-08.
ON A MOTION by Paul Lambert, seconded by Linda Spevacek, the Commission voted to approve an application seeking a special permit for the retail sale of antiques, for property located at 114 West Granby Road, File Z-15-08, with the following conditions:
Conditions of Approval:
- The antique sales are approved in accordance with Section 8.9 of the Zoning Regulations and the operation must remain in full compliance with this section at all times.
- The antique sales shall not commence until such time that the Building Inspector has approved the building for the retail use.
- The antique sales shall not commence until such time that the site has been improved in accordance with the parking plan, identified as exhibit A.
- The easterly driveway shall not be used for the business and shall be closed in accordance with the report submitted by the applicant’s traffic engineer, Stephen Mitchell of F.A. Hesketh and Associates. The report is identified as exhibit B.
- Enter and Exit signs shall be placed at each of the driveways in accordance with exhibit A. The signs shall be of residential character, printed on wood panels no larger then 8” x 12” and placed on simple posts.
- All sales must occur inside of the antique barn. Displays and storage of merchandise outside of the building and in public view are strictly prohibited.
- The antique sales are permitted on Tuesday through Friday from 10:00 am to 4:00 pm and on Saturdays and Sundays from 9:00 am to 5:00 pm.
- The Nug and Bug Antiques sign is approved as proposed. If the sign is to be illuminated, the light intensity must be very low, equal to no more than a 100-watt bulb and the light must be clearly directed to the sign face without any spillover. The Director of Community Development shall review the lighting, if any, to determine compliance with this requirement. No additional signs, advertising the antique sales are permitted on the property and the placement of signs that advertise the antique sales off of the immediate premises is prohibited.
- Any exterior lighting shall be of a residential style and only as approved by the Director of Community Development.
- The use of the barn for the sale of antiques shall cease on November 15, 2010, unless re-approved by the Commission. After August 1, 2010 the Commission shall hold a public hearing to solicit comments on the prior use of the barn for the antique sales to determine the impact on the community. This public hearing will be held upon a written request to hold the hearing by the applicant. Following the public hearing, the Commission may vote to revoke the Special Permit, to permit the continuation of the use of the barn for antiques sales or to permit the use with conditions.
All approved, as the Commission found that the application is in conformance with Section 8.2 and 8.9 of the Zoning Regulations.
The Commission held a discussion of an application seeking a special permit for the sale of alcohol under a package store permit for property located at 9 Bank Street; store front 9-A, File Z-16-08.
ON A MOTION by Margaret Chapple, seconded by Linda Spevacek, the Commission voted to approve an application seeking a special permit for the sale of alcohol under a package store permit for property located 9 Bank Street, store front 9-A, File Z-16-08, with the following condition:
The approval shall become null and void on April 15, 2009 unless the State Liquor Commission has issued a Package Store Liquor Permit for the property prior to this date.
All approved as the Commission found that the application is in conformance with Section 8.2 and 8.3 of the Zoning Regulations.
The Commission held a discussion of an application seeking a special permit for a farm store and the sale of wine under a farm winery liquor permit for property located at 84 Lost Acres Road, File Z-17-08.
ON A MOTION by Paul Lambert, seconded by Margaret Chapple, the Commission voted to approve an application seeking a special permit for a farm store and the sale of wine under a farm winery liquor permit for property located at 84 Lost Acres Road, File Z-17-08, with the following conditions:
- The farm store and site shall be developed as generally shown on a plan prepared for Michelle Niedermeyer and Kevin Riggott, 100 Lost Acres Road, dated 11-3-08, Drawing No. 08-39.
- The design of the farm store building shall be as generally depicted in the renderings prepared and presented by the applicant.
- The farm store and the sale of wine shall operate in general conformity with the applicant’s proposal, dated November 7, 2008, titled Application for Special Permit, Farm Store, Lost Acres Vineyard.
- The winery shall operate in accordance with the requirements of Public Act 06-67, an Act Concerning Farm Wineries.
- The sale of alcoholic beverages is permitted only as outlined under a Farm Winery Liquor Permit, as defined by the State of Connecticut Liquor Control Act.
- The Farm Store shall operate in compliance with the Granby Zoning Regulations, Section 8.15.17, Farm Stores.
- Exterior lighting shall be of a residential style with fixtures located on the farm store building.
- The farm store may be opened to the public from March 1, through December 31 of each year.
- The farm store may be opened to the public on Tuesday through Sunday, 12 noon to 6:00 pm. and on holidays.
All approved as the Commission found that the application is in conformance with Section 8.2, 8.3 and 8.15 of the Zoning Regulations. The Commission also found that the application is in conformance with the objectives of the Zoning Regulations and the goals of the Plan of Conservation and Development primarily as they relate to the support of farming and agriculture.
Fran Armentano reported that Fiddle Head Farm, 74R Silkey Road has requested a renewal of their Special Permit for the sale of antiques. He anticipates that a public hearing will be held on this matter on January 13, 2008. Fran also believes that the Commission will receive reports on proposed Granby Center Zone and on Ridgeline Zoning in early 2009.
Staff Reports and Correspondence:
Fran reported on the status of Powder Mill Road and Cider Mill Heights, both of which the Town now owns. Fran is overseeing the completion of the roads and recently put out to bid the final survey work.
Fran reported that Edward Sweeney, Town Engineer, will be retiring in January, after 30 years of dedicated service to the Town of Granby. Fran praised Ed’s achievements and abilities and noted that the Town was exceptionally well served by Mr. Sweeney. Commission members thanked Ed for all that he has done for the Town and wished him well. Fran expects that a new Town Engineer will be announced soon.
