ZONING BOARD OF APPEALS
MINUTES
March 17, 2009
Present: Wayne Chapple, Kelly Rome, William Percival, Dianne Maher (for Ann Crimmins), and Judy Goff
Chairman Wayne Chapple convened the meeting at 7:35 p.m. and secretary W. Percival acknowledged the Legal Notice. The Legal Notice was published on March 6, 2009 and March 13, 2009 in the Hartford Courant.
REGULAR MINUTES
ON A MOTION by K. Rome, seconded by D. Maher, the Board voted unanimously (5-0-0) to approve the minutes of the regular meeting of September 16, 2008.
Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.
The appeal by Robert R. Messier agent for J & E Investment, 9 Powder Mill Lane, seeking a variance to the front yard set back requirements, Section 5 of the Zoning Regulations for a garage, opened at 7:38 p.m.
Robert Messier, 288 Main Street, Manchester, CT appeared on behalf of the property owner, J & E Investment. He explained that the property at 9 Powder Mill Lane was purchased through a foreclosure action. When this property was purchased, most of the house was built. Once acquired by the new owner, it came to light that although the original plans showed the positioning of the house and attached garage set back appropriately from the front property line, it was actually built only 45.6 feet back from the front property line, which is 4.4’ closer to the front property line then required. Stating it would be a hardship to move the house back, citing the wetlands on the lot, the applicant is asking for a variance.
Public comment: There was none.
This public hearing closed at 8:03 p.m.
ON A MOTION by K. Rome, seconded by D. Maher, the Board voted unanimously (5-0-0) to approve a variance to the front yard set back requirements, Section 5 of the Zoning Regulations for Robert R. Messier, agent for J & E Investment, 9 Powder Mill Lane, as follows:
a 5’ variance is granted for an existing garage as outlined within the subject application, citing Section 10.3.1.2 of the Zoning Regulations. The request and approval for this variance is due to the unusual circumstances of the original owner having built this, then the property going into foreclosure. The hardship noted, is the location of the wetlands on this property, making it impractical to position the house back further on the lot.
The meeting adjourned at 8:08 p.m.
