INLAND WETLANDS AND WATERCOURSES COMMISSION
MINUTES
September 9, 2009
PRESENT: Chairman David Tolli, Barry Avery, Richard Martindale, Charlie Katan, Richard Van Nostrand and David Askew, Technical Advisor to the Commission.
Chairman Tolli called the meeting to order and confirmed a quorum at 7:02p.m.
MINUTES: On page 3 of August 12, 2009 minutes, under the matter of 19 Barn Door Hills Road, it should state that the lease holder (not the owner) wants to fill in the channel.
ON A MOTION by Mr. Avery, seconded by Mr. Martindale, the commission voted (4-0-0) to accept the minutes of the August 12, 2009 meeting with the above correction.
PUBLIC HEARINGS
2a. Wetland Boundary Change, 192 West Granby Road, Ed Sansone
Mr. Avery recused himself from any discussion on this matter.
The soil scientist retained by Mr. Sansone reports that the area of 4,500 square feet of wetland on the one acre lot is isolated wooded wetland. Mr. Askew reports that wet areas are not consistant with true wetland soils. There are a lot of variable soil conditions on the property.
The public was invited to comment.
Dan Fink, of 182 West Granby Road submitted a letter to the commission which was read to those in attendance by the Chairman. Mr. Fink has resided at 182 West Granby Road since 1968. He bought the lot at 184 West Granby Road and put a house on it for his daughter and son-in-law. He had had interest in purchasing the lot next to it, however, the second lot was too wet and he opted out of the purchase considering it undesirable.
John Hyatt, 184 West Granby Road, opposes any activity on 192 West Granby Road. He has lived on his property for 10 years. He had discussed the lot next to his with the then building official, Henry Miga, who told him the lot would be unbuildable. Soon after, truck loads of sand and fill were brought in to that lot. Water on Mr. Hyatt’s property has increased since then. He is concerned that building at 192 West Granby Road will further dampen his property.
Lucille DelCompo, 196 West Granby Road, has resided on her property since 1966. She submitted a package to the commission that includes photos of the wet areas at 192 West Granby Road and a sketch of the area. Her concerns are of potential sewage contamination of the vernal pools on her property. Ms. DelCompo reports that she has witnessed years in which the lot has been wet all year. She further states that she is concerned that building at 192 West Granby Road may increase water on her property.
Chairman Tolli points out that the wetland boundary as shown on the submitted map has been verified by both a hired expert and the town’s wetlands expert. Mr. Martindale walked the property and has no issue with the way the wetlands are mapped.
ON A MOTION by Mr. Martindale, seconded by Mr. Van Nostrand, the commission closes the public hearing. (3-0-0)
WETLAND BOUNDARY CHANGES
3a. 192 West Granby Road, Ed Sansone
ON A MOTION by Mr. Martindale, seconded by Mr. Van Nostrand, the commission accepts the wetland boundary change as depicted on the following map:

ON A MOTION by Mr. Van Nostrand, seconded by Mr. Martindale, the commission decides to hold a public hearing on this matter.
CEASE ORDER:
5a. Cynthia Anne Berkowitz, 63 Cooley Road (11/2/2005)
Chairman Tolli read the letter from the town attorney to the town manager. A check in the amount of $3,500 was enclosed with the letter. The remediation has been completed to the satisfaction of the designated agent. A permanent injunction has been placed so that the case may be revisited at any time. Any future activities must submit for the proper permits.
ON A MOTION by Mr. Martindale, seconded by Mr. Van Nostrand, the commission agrees that a letter shall be sent stating that the cease order will be removed since the penalty fee has been received and the remediation has been complete. (4-0-0)
5b. Cambridge House, redux
Tom Grimaldi, engineer for the redesign, has nearly completed the work. Commission members are invited to visit the site at any time and Mr. Grimaldi will answer any questions members may have. He will sent a letter to the commission advising them that work is complete.

David Tolli and David Askew walked the property. They asked the logger to hold off on activities until conditions were dryer. The logger has a permitted use of right. Mr. Askew will continue to monitor activity.
2. 19 Barn Door Hills Road, fill in depression on farm field
All materials to fill in the depression will come from tilled field. The lease owner will till first, put in a cover crop this fall and then will fill in and smooth the area in the spring.
ON A MOTION by Mr. Van Nostrand, seconded by Mr. Katan, the commission authorizes the designated agent to sign the request.
MISCELLANEOUS:
7a. Manitook Lake, milfoil
The chemical treatment appears to be effective. There is a lot of dead floating vegetation in the lake.

The next monthly meeting is October 14, 2009 at 7:00 p.m. in the Town Hall meeting room.
