ZONING BOARD OF APPEALS
MINUTES
March 16, 2010

Present:        William Percival, Kelly Rome, Suzanne Yucha, Dianne Maher, and Robert Lindeyer  

Acting Chairman William Percival convened the meeting at 7:30 p.m. and read the Legal Notice.  The Legal Notice was published on March 5, 2010 and March 12, 2010 in The Hartford Courant.

REGULAR MINUTES

ON A MOTION by R. Lindeyer, seconded by S. Yucha, the Board voted (4-0-1) to approve the minutes of the regular meeting of November 17, 2009 as presented.  D. Maher abstained from voting.

Acting Chairman Percival explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.

The appeal by Patrick and Lori Hoover, seeking a variance to the side and rear yard set back requirements, Section 5 of the Zoning Regulations, for the construction of a barn at 4 Powder Mill Lane, opened at 7:33 p.m.

Patrick and Lori Hoover, 4 Powder Mill Lane, appeared and spoke to the Board.  They showed a color coded map of their property and explained where they would like to place the proposed 36’ x 46’, one story barn with a hayloft and why it is the best area to place it.  They pointed out where the wetlands are and the septic and well locations, as well as some drainage areas.  Mr. Hoover stated they have a history of water in the basement and showed where the sump pump drainage goes to.  The Board members and the Hoover’s discussed clarification as to how much of a variance is necessary.  It was determined that a 25’ rear yard variance and an 11’ side yard variance would be adequate for the Hoovers.  

Public comment:  There was none, but Mr. Hoover delivered a letter from Carol Hipkins, 234 Loomis Street, who stated she has no objection to the Hoover’s building a barn on their property.  

This public hearing closed at 7:52 p.m.

ON A MOTION by K. Rome, seconded by D. Maher, the Board voted unanimously (5-0-0) to approve a variance to rear and side yard requirements, Section 5 of the Zoning Regulations for Patrick and Lori Hoover, 4 Powder Mill Lane, as follows:

a rear yard variance of 25 feet and a side yard variance of 11 feet is granted to allow for the construction of a barn, as presented at the hearing and as outlined in the subject file.  The hardships noted are the wetlands on the property, the location of the well and septic system, and the drainage system in place.  

The meeting adjourned at 8:03 p.m.
