ZONING BOARD OF APPEALS
MINUTES
April 20, 2010

Present:        Wayne Chapple, William Percival, Suzanne Yucha, and Dianne Maher  
Also present:   Francis Armentano, Director of Community Development

Chairman Wayne Chapple convened the meeting at 7:32 p.m. and W. Percival read the application descriptions, whereas a legal notice was not required for either application.  

REGULAR MINUTES

ON A MOTION by S. Yucha, seconded by W. Percival, the Board voted (3-0-1) to approve the minutes of the regular meeting of March 16, 2009 as presented.  W. Chapple abstained from voting.

Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days.  Approval, when granted, shall be null and void if not filed within 90 days of the approval date.

PUBLIC HEARINGS

The hearing on the application seeking a Certificate of Approval, per Section 14-54(b) of the Connecticut General Statutes for permission to use property located at 541 Salmon Brook Street for automobile sales and repairs, with the Applicant being Tire King LLC/Grillo Enterprizes, opened at 7:34 p.m.

Frank Grillo, property owner at 541 Salmon Brook Street appeared to explain his request.  He is opening a new business and would like to add car sales and repairs.  He has obtained state approval to do Emissions Testing and will move forward to provide this service to the residents of Granby and surrounding towns.  

F. Armentano provided aerial photos showing the property.  The site was originally limited to a certain number of cars with a requirement that the cars be set back a specific distance from the road.  Mr. Grillo will need to seek approval from the Planning and Zoning Commission in order to display cars for sale on the site.  Granby Police Department review is anticipated, as a signature is required on the DMV form from the Granby Police Department.  

When asked how many cars would be on the premises at any given time, Mr. Grillo responded about 50.  Of these, 20 – 22 cars will be displayed for sale.  The balance would be cars that are parked there temporarily for service.  He went on to say he hopes to start a towing service in this area as well, although there would not be an impound lot in Granby, that would be at his facility in East Granby.  His hours of operation will be addressed by Planning and Zoning.  

Public comment:  There was none.  

This public hearing closed at 7:46 p.m.

The hearing on the application seeking a Certificate of Approval, per Section 14-54(b) of the Connecticut General Statutes for permission to use property located at 349 Salmon Brook Street for automobile sales and repairs, with the Applicant being John Bouchard III, opened at 7:47 p.m.

John Bouchard, 13 Grove Street, Enfield, CT and John Petersen, property owner at 349 Salmon Brook Street appeared to explain this request.  Mr. Bouchard plans to lease this property for his car repair business and for some car sales.  He will have to go before the Planning and Zoning Commission for permission to display cars for sale.  Mr. Petersen provided a copy of a map showing the location of the property.  Mr. Bouchard explained his Dealership License would allow him to repair and sell cars.  He said cars will not be displayed at the front of the property but instead he will have a website showing the cars he has for sale.  He plans to do Emissions Testing in the future.  Mr. Petersen explained Mr. Bouchard would be leasing the back portion of the building.  F. Armentano noted that area of the building is in a flood plain and Mr. Petersen stated that portion of the building was built high enough to avoid flooding.  Instead of making a new sign, the existing sign at the front of the property will be modified and used.  

Public comment:  There was none.  

This public hearing closed at 8:02 p.m.

Chairman Chapple thanked Mr. Armentano for attending this meeting.  

ACTION ON APPLICATIONS

ON A MOTION by D. Maher, seconded by S. Yucha, the Board voted unanimously (4-0-0) to approve the application by Tire King LLC/Grillo Enterprizes seeking a Certificate of Approval, per Section 14-54(b) of the Connecticut General Statutes for permission to use property located at 541 Salmon Brook Street for automobile sales and repairs.  No cars may be located on the site “for sale” without the prior approval of a site plan from the Planning and Zoning Commission.  

ON A MOTION by D. Maher, seconded by S. Yucha, the Board voted unanimously (4-0-0) to approve the application by John Bouchard III seeking a Certificate of Approval, per Section 14-54(b) of the Connecticut General Statutes for permission to use property located at 349 Salmon Brook Street for automobile sales and repairs.  No cars may be located on the site “for sale” without the prior approval of a site plan from the Planning and Zoning Commission.  

The meeting adjourned at 8:06 p.m.
