ZONING BOARD OF APPEALS
MINUTES
December 21, 2010
Present: Wayne Chapple, Kelly Rome, J. Goff, Ann Crimmins, and Suzanne Yucha
Chairman Wayne Chapple convened the meeting at 7:30 p.m. and acting secretary J. Goff read the Legal Notice. The Legal Notice was published on December 10, 2010 and December 17, 2010 in the Connecticut Section of the Hartford Courant.
REGULAR MINUTES
ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted (4-0-1) to approve the minutes of the regular meeting of November 16, 2010 as presented. J. Goff abstained.
ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted (4-0-1) to approve the minutes of the special meeting of November 17, 2010 as presented. S. Yucha abstained.
Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days. Approval, when granted, shall be null and void if not filed within 90 days of the approval date.
PUBLIC HEARING
The hearing on the appeal by Mark Sticca, seeking a variance to side yard requirements, Section 5.1 of the Zoning Regulations to allow construction of a garage for property located at 33 Zimmer Road, opened at 7:33 p.m.
Mike Grillo appeared representing Mark Sticca of 33 Zimmer Road. He explained the plans for a two-car garage to be built, set back from the house by approximately 12 to 15 feet. He stated that the driveway, once brought to the proper height and graded, will not create any issues with water runoff to abutting properties. He also noted that the driveway will be within the width of the garage. There is presently a shed on the property, which will be removed prior to building the garage. The well is located in the front yard and the septic system is in the back yard. Also noted is the fact that this is a small, nonconforming lot.
Public comment: Dave Hamilton, 35 Zimmer Road, who had written a letter to Francis Armentano, Director of Community Development noting his concerns regarding water runoff into his yard, was at this meeting. After listening to the presentation by Mr. Grillo, Mr. Hamilton stated his concerns seem to have been addressed and he has no opposition to Mr. Sticca’s plans, provided that the garage is constructed as proposed.
The public hearing closed at 7:44 p.m.
ON A MOTION by K. Rome, seconded by A. Crimmins, the Board voted unanimously (5-0-0) to approve a variance to side yard requirements, Section 5.1 of the Zoning Regulations for Mark Sticca, 33 Zimmer Road, as follows:
the approved 14-foot variance to the side yard permits the construction of a garage, which may be located no closer than six feet to the property line, as outlined in the subject file. As a condition of this approval, no portion of the driveway may be closer than six feet to the property line and careful consideration must be taken so that no drainage will run onto the neighbor’s property. The hardship noted is the fact that this is a nonconforming lot, along with the location of the septic system and the well preventing the garage from being built elsewhere.
The meeting adjourned at 7:48 p.m.
