ZONING BOARD OF APPEALS
MINUTES
February 15, 2011
Present: Wayne Chapple, Kelly Rome, Suzanne Yucha, Ann Crimmins, and William Percival
Chairman Wayne Chapple convened the meeting at 7:30 p.m. and secretary W. Percival read the Legal Notice. The Legal Notice was published on February 4, 2011 and February 11, 2011 in the Connecticut Section of the Hartford Courant.
REGULAR MINUTES
ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted (4-0-1) to approve the minutes of the regular meeting of December 21, 2010 as presented. W. Percival abstained.
Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days. Approval, when granted, shall be null and void if not filed within 90 days of the approval date.
PUBLIC HEARING
The hearing on the appeal by Valley Office Trust, seeking a variance to side yard requirements, Section 5.0 of the Zoning Regulations to allow construction of an addition for property located at 29 Hartford Avenue, opened at 7:32 p.m.
Edward Voskowsky appeared in his capacity as Agent for Valley Office Trust of 29 Hartford Avenue. He explained the plans for a proposed 16’ x 24’ addition to an existing commercial building. He stated there is no other location to put an addition citing the location of the septic tank and leach fields, an underground oil tank, and a water line to the west of the building.
Public comment: There was none.
Chairman Chapple read a letter written to Mr. Voskowsky from Wendy van Welie, owner of property at 25 Hartford Avenue, stating she has no objection to the proposed plans to expand the building.
The public hearing closed at 7:42 p.m.
ON A MOTION by K. Rome, seconded by A. Crimmins, the Board voted unanimously (5-0-0) to approve a variance to side yard requirements, Section 5.0 of the Zoning Regulations for Valley Office Trust, for property located at 29 Hartford Avenue as follows:
a 6-foot side yard variance is granted to allow for an addition to an existing commercial building. The hardship noted is the location of an underground oil tank, septic tank and leach fields, and a water line.
The meeting adjourned at 7:44 p.m.
