ZONING BOARD OF APPEALS
MINUTES
June 16, 2009

Present:        Wayne Chapple, Kelly Rome, Ann Crimmins, William Percival, and Dianne Maher (for Judy Goff)

Chairman Wayne Chapple convened the meeting at 7:30 p.m. and secretary W. Percival read the Legal Notice.  The Legal Notice was published on June 5, 2009 and June 12, 2009 in the Register Citizen/Granby News.

REGULAR MINUTES

ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted unanimously (5-0-0) to approve the minutes of the regular meeting of March 17, 2009 as presented.  

Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.

The appeal by Dorothy Hayes, 348 North Granby Road, seeking a variance to front yard requirements, Section 5.1 of the Zoning Regulations to allow construction of an addition, opened at 7:34 p.m.

Jeffrey Walker, 143 Donahue Road, appeared on behalf of the property owner, Dorothy Hayes.  He explained the house is approximately 80 years old and non-conforming.  The proposed plans would add to the existing kitchen, an area 12’ back from the face of the house.  This is approximately a 3.5 acre lot and there is no present day site plan of the property.  The well is located in the basement and the septic system is located on the south side of the property.  Salmon Brook is in back of the house preventing building out that way and to the north is the driveway.  The hardship noted is that due to its age, the house is non-conforming.  There is no other reasonable place to put the addition.

Public comment:  There was none.  

This public hearing closed at 7:41 p.m.

ON A MOTION by K. Rome, seconded by D. Maher, the Board voted unanimously (5-0-0) to approve a variance to front yard requirements, Section 5.1 of the Zoning Regulations for Dorothy Hayes, 348 North Granby Road, as follows:

a 30’ variance to the front yard requirement is granted for an addition as outlined within the subject application, citing Section 5.1 of the Zoning Regulations.  The request and approval for this variance is due to the hardship of a non-conforming lot, wetlands located behind the house, and the location of the septic system.  

The meeting adjourned at 7:46 p.m.
