ZONING BOARD OF APPEALS
MINUTES
August 18, 2009
Present: Wayne Chapple, Kelly Rome, Ann Crimmins, Judy Goff, and S. Yucha (alternate for Bill Percival)
Chairman Wayne Chapple convened the meeting at 7:30 p.m. and acting secretary J. Goff read the Legal Notice. The Legal Notice was published on August 7, 2009 and August 14, 2009 in The Hartford Courant.
REGULAR MINUTES
ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted (4-0-1) to approve the minutes of the regular meeting of July 21, 2009 as presented. S. Yucha abstained.
Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.
The appeal by Matthew McCarthy, 32 Hemlock Road, seeking a variance to front and side yard requirements, from both Hemlock and Running Pine Road, Section 5.1 of the Zoning Regulations to allow construction of a garage and deck, opened at 7:33 p.m.
Conrad Emmons, 6 Spoonville Road, East Granby, contractor for Matthew McCarthy, appeared to explain the request for a variance of 44.5’ to front and side yard requirements. The requested variance for building a garage is withdrawn at this time. The proposed deck will be a floating deck, to extend to the back of the house from the existing front deck. The lot is small and the backyard slopes down. Mr. Emmons showed where the new septic system and leech field is located. He stated he can’t put piers into the ground for the deck because of the location of the septic system and leech field. The property has recently been surveyed. The location of the well is unknown. Mr. Chapple noted reference to a shed on the application. Upon clarification, whereas the request for a variance to
build a garage has been withdrawn, the shed in question does not need to be moved and becomes a moot point.
Public comment: There was none.
This public hearing closed at 7:56 p.m.
ON A MOTION by S. Yucha, seconded by A. Crimmins, the Board voted unanimously (5-0-0) to approve a variance to front yard requirements, Section 5.1 of the Zoning Regulations for Matthew McCarthy, 32 Hemlock Road, as follows:
a front yard variance of 44.5 feet is granted to allow for the construction of a deck, as outlined within the subject application. The variance permits the deck to be located no closer than 5.5 feet to the street line. The request and approval for this variance is due to the hardship, which is created by the nonconforming lot and the fact that there is no other feasible location for a deck. The remainder of the request has been withdrawn.
