ZONING BOARD OF APPEALS
MINUTES
October 20, 2009

Present:        Wayne Chapple, Kelly Rome, Ann Crimmins, William Percival, and Judy Goff  

Chairman Wayne Chapple convened the meeting at 7:30 p.m. and secretary William Percival read the Legal Notice.  The Legal Notice was published on October 9, 2009 and October 16, 2009 in The Hartford Courant.

REGULAR MINUTES

ON A MOTION by A. Crimmins, seconded by K. Rome, the Board voted unanimously (5-0-0) to approve the minutes of the regular meeting of August 18, 2009 as presented.  

Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.

The appeal by Richard Kirschbaum, seeking a variance to rear yard requirements and minimum lot area, Section 5.1 of the Zoning Regulations to allow an addition to an existing garage and to improve lot layout for properties at 26 and 28 East Granby Road, opened at 7:33 p.m.

Richard Kirschbaum appeared and spoke to the Board.  He explained he owns both properties and would like to extend an existing garage by 10 feet on the property at 26 East Granby Road.  He looked at sketches of the properties with the Board and noted that in back of the garage the property drops off considerably.  He is asking for a 27-foot variance to allow the addition to be within 3 feet of the rear yard line.  

The second part of this application asks for a variance to reduce the area of property at 28 East Granby Road to no less than 20,000 square feet.  His intension is to add the land area taken from 28 East Granby Road to property at 26 East Granby Road.  

The Board questioned if they have the authority to change a property line.

Public comment:  There was none.  

This public hearing closed at 7:48 p.m.

The appeal by Robert and Gail Blanc, 25 Buttles Road, seeking a variance to side yard requirements, Section 5.1 of the Zoning Regulations to construct a carport, opened at 7:49 p.m.

Robert Blanc appeared to explain his request.  He brought pictures of his property showing where he would like to place the carport and pointed out the tree line that separates his and his neighbor’s property at 21 Buttles Road.  He is requesting an 18-foot variance.  

The Commission asked Mr. Blanc if the requested variance took into account any future plan to convert the carport to a garage and how the roof overhang might impact the request.  He stated there isn’t much of an overhang in the plans.  It was noted the septic system is located in the back of the property and the well is located in the front yard.  
Mr. Blanc handed a letter to Chairman Chapple from Robert D. Evans and Jody D. Evans, 21 Buttles Road.  Chairman Chapple read the letter to the Board, which stated they have no objection to the Blanc’s proposed carport addition.

Public comment:  There was none, although Mrs. Blanc attended the meeting and stated she is in full agreement of the plans for a carport.  

The public hearing closed at 7:58 p.m.

ON A MOTION by J. Goff, seconded by A. Crimmins, the Board voted unanimously (5-0-0) to table a decision for a variance to rear yard requirements and minimum lot area, Section 5.1 of the Zoning Regulations for Richard Kirschbaum 147 Silkey Road, as follows:

in order to research past decisions that might be similar to these circumstances.  The Board noted that the applicant might be able to move the proposed addition to the front of the building, therefore making a request for a variance unnecessary.  This matter will be placed on the Agenda for November.

ON A MOTION by K. Rome, seconded by A. Crimmins, the Board voted unanimously (5-0-0) to approve a variance to side yard requirements, Section 5.1 of the Zoning Regulations for Robert and Gail Blanc, 25 Buttles Road, as follows:

a side yard variance of 18 feet is granted to allow for the construction of a carport, as outlined within the subject application.  The hardship noted is that this is a nonconforming lot and the location of the septic system and well had to be taken into consideration when deciding where to place the carport.  

The meeting adjourned at 8:31 p.m.
