ZONING BOARD OF APPEALS
MINUTES
November 17, 2009
Present: Wayne Chapple, Kelly Rome, Suzanne Yucha, William Percival, and Robert Lindeyer
Chairman Wayne Chapple convened the meeting at 7:30 p.m. and secretary William Percival read the Legal Notice. The Legal Notice was published on November 6, 2009 and November 13, 2009 in The Hartford Courant.
REGULAR MINUTES
ON A MOTION by K. Rome, seconded by W. Percival, the Board voted (3-0-2) to approve the minutes of the regular meeting of October 20, 2009 as presented. R. Lindeyer and S. Yucha abstained from voting.
Chairman Chapple explained the procedure of the meeting and noted to those in attendance that decisions would generally be mailed to the applicant within 10 days and that a variance certificate, when granted, shall be null and void if not filed within 90 days of the approval date.
The appeal by Robert Taylor, seeking a variance to rear yard requirements, Section 5.1 of the Zoning Regulations, for the construction of an addition to an existing house for property at 22 Pendleton Road, opened at 7:32 p.m.
Robert Taylor, 22 Pendleton Road, appeared and spoke to the Board. He explained that the existing foundation for his house is crumbling. He would like to build a new foundation and extend the house by 8 feet. He showed pictures of the existing house and foundation to the Board members. Because this property has city water, the location of a well is not an issue. The septic system is located to the right of where the new foundation is proposed to go and does not create an issue. Mr. Taylor is amending his request and is asking for a variance of 20 feet from the property line to take into account the overhang of the structure.
Public comment: There was none.
This public hearing closed at 7:39 p.m.
ON A MOTION by K. Rome, seconded by R. Lindeyer, the Board voted unanimously (5-0-0) to approve a variance to rear yard requirements, Section 5.1 of the Zoning Regulations for Robert Taylor, 22 Pendleton Road, as follows:
a rear yard variance of 20 feet is granted to allow for the extension of the existing house by an addition of 8 feet, as outlined within the subject application. The hardship noted is that this is a nonconforming lot and the pitch of the land eliminates expanding the foundation elsewhere.
The Board moved on to the voting session regarding the applications, from the October 20, 2009 meeting, by Richard Kirschbaum, 26 and 28 East Granby Road. Francis Armentano, Director of Community Development, was present to discuss details of these requests. The Board discussed approving an area variance for a nonconforming lot, therefore making it conforming by variance. They also discussed approving a rear yard variance to allow the extension of an existing garage.
ON A MOTION by R. Lindeyer, seconded by S. Yucha, the Board voted unanimously (5-0-0) to approve a variance to rear yard requirements, Section 5.1 of the Zoning Regulations for Richard Kirschbaum, 26 and 28 East Granby Road, as follows:
a rear yard variance of 27 feet is granted to allow for the construction of an addition to an existing garage, as outlined within the subject application. The hardship noted is the nonconformance of the lot and building.
ON A MOTION by W. Percival, seconded by S. Yucha, the Board voted unanimously (5-0-0) to approve a variance of minimum lot area, Section 5.1 of the Zoning Regulations for Richard Kirschbaum, 26 and 28 East Granby Road, as follows:
to reduce the required minimum lot area of property at 28 East Granby Road to no less than 20,000 square feet. The land area that will be taken from 28 East Granby Road shall be added to the property at 26 East Granby Road, by extending the easterly property line of 26 East Granby Road to the rear property line of 28 East Granby Road, as outlined within the subject application, thereby creating more conforming lots.
